How many people are closing there stores due to the new sales tax law or are you just going to wait it out to see what happens, Does the law become effective when the supreme court ruled on it or do the states have to enact the law. Thanks

On the Proposition 65. all you have do is get some decals and post them on your product I sell decals and might not need to meet that law if I do I just won’t sell there either

Etsy is looking better and better each day to sell on they are paying taxes that need to be paid on some states

Etsy is not paying the tax, they are collecting it from the buyers and remitting it to the appropriate states.

That is true but the seller does not have to worry about the taxes collected for that state only the states not collected

We just received our notice from the State of Minnesota that starting Oct 1. we have to register and remit tax to all local and counties we sell into if we are over only 100 items or $100,000. We sell a lot of low dollar items and would have issues in at least 2-3 states based on numbers but not dollar amounts. Even if eBay collects for us all I can see is a paperwork nightmare to be compliant. Has anybody found any solutions?

Same here, this is a logistical nightmare and our business is probably going to close because of it. This is the worst case scenario happening in front of our eyes.

So far most States seem to be implementing Marketplace Facilitator laws. So Ebay will be responsible for collecting and remitting taxes on sales through them. Minnesota is one of the States Ebay is already collecting for.
The bigger issue will be if you have sales elsewhere that have taxes you will be responsible for.

I am a casual seller on ebay with annual sales well under all the economic nexus(s) and volume of annual sales well under that nexus, then I do not have to deal with sales or use tax at all except for sales in my own state? I have maybe 20 to 25 sales a year, with annual income of only several hundred dollars, and it has been this way for years. thank you

It's a tax on the sales TRANSACTION, so it would apply if the item was sold once, or a hundred times. Each time it sells, tax is owed.

I agree 100%. I too live in California and our sales tax is high but NOT that high. This particular seller is charging California buyers too much for sales tax.

If I had a store I would wait to see what happens. It seems a bit rash to me to assume you know exactly how millions of buyers around the world are going to react.

Each state can pass its own law with its own timetable.
The Supreme Court only ruled on South Dakota's law - it did not give states cart blanche to do whatever they want.
Part of the reason the Supreme Court allowed South Dakota to prevail was the fact the law had an exemption for small sellers and/or a system that put the burden of collection and reporting on sites like eBay ('facilitators') rather than on individual sellers.
