Did you mean:

So buyer call me a "SCAMMER" not violating feedback policy.

A buyer tried to scam me by claiming the phone he recieved from me had cracked screen. Then I found he used photos grabbed from other website. He openned a return request, but did not send the item back to me. Now the case is closed and I received the payment from Paypal.

Now he left a negative feedback on me and call me a scammer. Ebay customer service says this does not violate their feedback policy.

This does not make any sense.

"Now the case is closed and I received the payment from Paypal"

The case is closed and you received payment from PayPal? What do you mean by that? Did eBay close the case in your favor?

Unless the case was closed in your favor eBay will not remove the feedback.

The case was closed in the buyer's favor after 10 min the buyer openned the case. I did not have time to do anything. But he did not send the item back, so I received the payment from Paypal.

I see, well since the buyer didn't return the item you have your money. The feedback doesn't violate any policy, and since eBay favored the buyer it won't be removed. I'm sorry this happened.

@jflycnnew  Buyers are NOT allowed to leave Negative Feedback before 7 days has past ... not sure if that's from delivery or purchase ... must be from delivery ... see it the neg FB was permitted prior to the 7 days ... if so call eBay and advise the neg FB was left against eBay Poicy and should be removed ... it's a long shot but certainly worth a try.  And besides, you were awarded the claim from PayPal.

@mr_lincoln,

That policy only applies to Power Sellers. OP is not a Power seller so feedback could be left at any time for the OP.

FWIW, I wouldn't have a problem buying from you after seeing that feedback, as your response was a lot more illuminating than the Neg you received.

My sincere thanks ... I knew I read that somewhere, just did not recall it was for Power Sellers only.

Could have been worse. Most sellers lose their money too. Start selling a lot of small, low cost items to get your feedback score up. Sales will be slow when buyers see your feedback score. Hopefully they will read your reply as it was very good. Then maybe they will buy. Best of luck to you.

The problem is the reply is limited by only a few words. It only takes a few words to call someone a scammer, but it takes more words to explain that you are not a scammer...

That's only for power sellers

If the buyer wanted to scam you, he would have succeeded...and may still.  You would have lost the case.  Expect to lose money every now and then.  Selling anywhere is not without its risks.
