Should I just start refunding without getting the item back?

So I sold an item and shipped it out the following day with tracking.  USPS shows they tried to deliver the package but apparently it was going to a buisness and was closed. This is the last update from USPS which still shows the item in transit. Buyer opens a case for INR, I upload the tracking information but it does not show up in the case like they normally do, keep in mind eBay should have this information since I created the shipping label thought their system. I am guessing the part is on its way back to me but USPS does not show if it is or not.  I told the buyer I would send it back out ounce I got the item back.  Never heard back.

Yesterday I see the buyer opened another case. I am not sure what kind but I am guessing another INR. Ebay decided in the buyers favor and said I did not respond to the case. The opening and closing seemed to happen within minutes and I now have a brand new defect for my time. Do you all believe I should have just sent a refund even though it still showed to be in transit. Chances are he will now have the refund and the item if USPS tries another delivery. How am I supposed to respond to a new case if it opened an closed withing minutes.  Shouldn't the buyer be responsible for having a location to recieve the package? Here are the details of what I have:

 Here's what happened

Oct. 17 :The case was resolved
Oct. 17 :The buyer has opened a case
CommentsSent the seller a message about my package about refund for days no hasnt responded

Oct. 2 :You added tracking details
Comments USPS show the buisness has been closed during delivery
Sep. 30 :The buyer didn't receive the item
Buyer wantsThe item
CommentsI bought the item but it has never came in the mail

@Anonymous   What do we do in this case?  It's another scam, they are using postal forwarding to keep the package moving while they claim INR because it wasn't delivered to the original address on time.

Re: Should I just start refunding without getting the item back?

Just a little update. The Post Office said this package is eligible for interception since the buyer paid for it to be transferred. I got to thinking if they issued a new tracking number. That would explain why the current number has not been updated. Just a thought, I am really not sure. They were not much of any help. I will have to talk to the Postmaster at my local office tomorrow.  I called eBay and you can guess how that went. The lady from the Philippines was very nice but stated the refund happened because it was well past the estimated time for delivery. I will to try to talk to someone Stateside tomorrow afternoon.

I am not concerned about the item, we average three or so thefts a month. This is the second this week. I had a buyer request a return on a small item a few weeks ago. Standard return of a small car part. Well the part was never sent back but I kept getting the annoying "Has the item been returned message" from eBay. These typically time out after a few weeks and nothing come of it. Fast forward to this week I get an eBay message that the item has been returned. I check the return status and it shows "buyer return" but their is no tracking number. Ebay says to refund now or they will do it for me, you all know the message. Being a cheap $10 item, I sent the refund instead of dealing with Ebays nonsense.  Buyer got to keep the item and got a refund. Good times for all 🙂

Sorry kind of getting off course, the thing is our Dealership has a primary Ecommerce site that sells thousands of dollars worth of parts per month. That site does not have nearly the amount of fraud as we have here on eBay. I have a lot of great eBay customers but the scammers are really taking a toll. I just do not see how it is right for a buyer to steal an item, get a full refund, the seller gets a defect and what will most likely end with a neg for my time. I had something simialur happen back in December of last year, defect and all. The odd thing about that one was the defect disapeared after a month. It is my understanding they last for a year. Like I said good time had by all.

I will post an update tomorrow. Thank you for all of  the help and suggestions, I check out these forums everyday to find out the lastest an greatest scams. It looks like this will be the one that takes away the last options sellers had for protection.

Question - Why did the c-s agent who took the call from the buyer not check the tracking prior to forcing the refund and see that this is an obvious scam?  Refused delivery is supposed to count the same as delivered when it comes to INR's.

Something doesn't seem right.  I agree that ebay should have looked at the tracking.
