Received an email through eBay saying that I could sell Phillips lighting products.  Has anyone gotten an email this?  Sold items on eBay for a long time and never received anything like this.

To Whom It May Concern:

This cease and decease notice is being sent on behalf of Philips Lighting North America Corporation (“Philips Lighting”). It has come to our attention that you have been selling certain Philips Lighting products, including [Philips 471986 Hue White Ambiance Starter Kit New] (collectively, “Philips Lighting Products”) without proper authorization through the on-line site eBay.

Please be advised that you are not authorized to sell the Philips Lighting Products and we demand that you immediately cease and desist from offering for sale, selling, advertising, marketing and/or promoting the Philips Lighting Products and that you remove your listings from [Philips 455295 Hue White A19 Single LED Light Bulb, Works with Alexa] and all other websites within 24 hours of receipt of this letter.

So did you receive a certified letter that replicates this email? If so, you may get more information from a hard-copy letter--like the name of philipligh25's company (a law firm or whatever), addresses, phone numbers, etc. I would comply with the Return Receipt procedure, just in case. Forewarned is forearmed, as they say.

Good catch! LOL! That, and repeating the year twice in the date line, smacks of a slipshod outfit, does it not? I wonder if I could get a job there. Or their. Or they're. Whichever.

Did you end up removing the listing? I got the same letter via ebay messaging today. If the request is actually valid, why wouldn't Phillips go through the eBay Vero program?

At this time they are simply asking you remove there product across the internet.  Some companies may ask you first while other may just move forward with VERO claims. 

 

I would not discount either of these directions as unworthy, but if you truly want to sell this bulb or many of these bulbs then you need to do your due diligence.

Also look into the First Sale Doctrine and Tabberone’s fight on eBay. If you legally own a legal product that follows ebay’s Rules I don’t see how Phillips can get away with this threatening behavior.

Did anyone also notice the misspelling of the company name in the user name?  If it was the actual company, there is no way they would have done this.  Seems much more likely this is a competitor.

By the way, VERO program is not going to give you a reprieve or an advanced notice. They will go immediately to take your items down and then explain you why they did it. I got one of those take downs yesterday, but they sent me the email address of the representative of the company alleging "intelectual property". 

 

I am going to have fun sending them the 30+ pages full of the same product being sold on Ebay. Smiley LOL
