Scammer or not very smart?

We sold a table top gaming miniature on our other account. More than 45 days after delivery the buyer filed a snad demanding a refund of more than half of the cost of the item because we had "overcharged" them. They claim that the figure we sold them is retail only $20 and they paid $60. We buy directly from the manufacturer in Europe and we pay more than $20 wholesale. We double checked the manufacturer's website and did a search of other sellers on ebay and of course no one was selling it for less than $45 and that was from Ukraine not the US. 

 

Ultimately ebay found in our favor. Then he opened a paypal case against us. He now claims that we misrepresented the size and that there are two sizes and we sent him the smaller which sells for $20 not the larger that sells for $60. He specifically stated we pulled a bait and switch. Then he goes on to claim that we lied in the listing that the item was from a different manufacturer(he never mentioned this in the ebay claim). This is false, we put in the listing that the model was compatable with a certain tabletop game, but specifically stated who the manufacturer was. 

 

We tries to have paypal close the case as it had already been decided by ebay, but they told us that isn't what they do anymore. We do decent sales(enougj to make an income from it) and we have never had a buyer like this. His initial message was very threatening and his paypal claim stated that he tried to be reasonable in the initial claim and ask for a partial refund but that we refused. 

 

Of course we will fight this with paypal too. Honestly, if he hadn't just demanded a more than 50% refund from the get go we probably would have accepted a return. But I don't think he wants a return and I am afraid that even if we win with paypal(we should as scale of model and pictures from listing match exactly what was sent) that he will just file a chargeback with his cc and we will be screwed as paypal won't cover us for a not as described even though it is.

 

Any thoughts?

That is why the best thing you can do is tell them to open a case and for you to check return for refund.

 

Partials is the worst thing ebay ever introduced.

 

If it is not the right size then why would he even want it?

 

So always return for refund.  Many times they just go away.

 

If not you get it back and then just resell it.

That is what we normally do, but this guy was over the 45 days and he didn't try to contact us at all, just demanded the ridiculous partial.

 

As models like these come unassembled(like any other model kit) we assume that he has already put it together by this point which makes it unsellable.🙁

Yes, but unfortunately getting past ebay is only half the battle.  Paypal gives them 6 months.

But he will have to pay for return shipping.

The reason they lost the eBay claim is because it was past the time limit.

 

For PayPal the time allowed is much longer, 180 days. Refusing to accept the return may not work out well for you.

 

But I don't think he wants a return

 

You are probably right which is why you should authorize the return.

The eBay claim is closed and as Jimmy said it was openned too late.

 

Paypal allows 180 days so you have a much harder fight. 

 

Then you have the credit card chargeback, an even more difficult fight.

 

Tell them to return for refund.  With paypal the BUYER has to pay return shipping, that may cool their jets a bit if they don't know this.   Regardless the best thing for you at this point is to repeat "return for refund" until they either return it or go away.

As others have said the buyer lost the dispute, because they waited too long to file on ebay. They would have lost it anyway because of the message they sent, which is buyer's remorse, and had you replied to the return request, that you only give full refunds, then contacted ebay's CS dept. and asked tem to review the message, you would have won, or they would have had to pay the return shipping.

I do not know if PayPal can still access old ebay messages, but you might want to contact Paypal  by phone, and ask if they can.  Even if you deleted it they might stil be able to see it. 

 

Make sure to add the buyer to your BBL.

I appreciate your responses and advice. But will Paypal really find in our favor if he sends an empty box, or a broken or assembled model? We are confident we will win with Paypal, but I am just curious if anyone has ever won with a credit card in a case like this.
