Sales Tax SCAM!

What a scam!

 

Not only is it spurious that Ebay collects sales tax - but it does so in a manner to enrich its' sister Paypal.

The sales tax is collected from the buyer.

Ebay sends that sales tax to the seller at paypal.

PAYPAL DEDUCTS A FEE ON THAT SALES TAX along as a sales total!!!!

Ebay gets the sales tax back to pay the states IF it wants and if anything is due (which is another question/scam).

PAYPAL KEEPS THE FEE ON THE SALES TAX!

YOU PAY FEES FOR EBAY TO COLLECT SALES TAX!!

So one has to calculate the sales tax, add an amount onto shipping or the goods to TRY and cover the ever increasing fee for those sales taxes.

 

Ebay shoud/could just keep the sales tax and pay it out direct to states. Adding the amount to the sale and allowing its partner Paypal to collect on that amount too is a pure scam. Something has to be done. Class action?

No lawyer really needed. Just social media and the facts:

 

Ebay net revenue is 360 million a month in the USA alone.
18 million at average 5% sales tax collected paid to paypal
paypal charges sellers 3 percent on that 18 million a month for a profit of
540,000 per month
6,480,000 per year sellers pay in FEES ON SALES TAX ALONE!

All that is based on Ebays net REVENUE in the US of 4.4bn a year. I am not sure if that is really the figure of all sales tax is collected on, but gives you an idea of the scam collecting sales tax and passing it as "sales" to Paypal unwinds.

 

That is 6 million a year bonus for Paypal as a gift from Ebay. Ebay is paypal and paypal is ebay. The integration is so vast it should be brought to the government under the RICO act. There are many ways to skin a cat and sometimes a frontal assault will only result in you getting scratched. 6 million for collecting taxes is a lot of BALDERDASH.

Nothing to do with collecting sales tax for states. The issue is ebay using Paypal as an easy conduit to collect that tax and charge a fee to the seller on that tax. A fee on taxes? Actually, if this worked properly Paypal should just pass that through to their Ebay accounts and not charge a fee to the seller for this accounting issue. The fact that Ebay ADDS a charge they need to pay the states to the transaction and, while paypal keeps that separate the paypal fee is added onto that part too! THAT is the real issue here. The extra 6 million a month paypal will steal from those who sell on ebay.

If your buyers are paying an average of 8% sales tax, for every $100 of your total sales, the 3% PayPal fee on the tax amount would be $0.24.

Other ways to skin cats - one is called RICO. What paypal and ebay are doing to pass the taxes, take a fee to do that, and then do no accounting to sellers as to when and how that tax money are paid AND the 6 million a year that paypal EARNS just on fees on taxes? FEES ON TAXES??? DOESNT THAT SOUND RIDICULOUS?

Ok, then I'll speak slowly for the mathematically impaired.

 

Tax on $100 is $8 (using 8% as example).

 

2.9% (rounded to 3%) of $8  is .24c. 

 

.24c is charged to you on a $100 sale.

That would not help. My whole thread is based on a sale to Nebraska today. First time I saw a sales tax. But I will try to not sell to those states - or not ship to them to stop those sales. But I think they are collecting for all states, even if they do not pay them.

I think you can not ship, or control the cost of shipping to these states. All you have to do is calculate 4 percent of a sale on top of all the costs for other states and add that to states that collect taxes. Where is a list of them? Or should I just add 4 percent on all of them? That 4 percent will cover the extra fees paypal adds for collecting that tax. Like all business costs - they get added to the cost of goods and to the end price.

It isn't a "scam".

 

Ebay found another way to process sales tax from what they were doing originally.  They needed to.  The original way was causing a great deal of confusion for buyers and they were getting lots of complaints.  They were also getting complaints from the various financial institutions and credit card companies involved due to all the small transactions.  So Ebay had to make a change.

 

I'm with everyone on this.  I don't like the additional PP fees involved in this.  I'm fortunate, for me it is a cost I can absorb.  I know for others, especially of high end items this is more problematic.  I respect that completely.

 

How would you suggest Ebay go about collecting the sales tax?  Knowing that all the little micro payments that were happening by the way Ebay started collecting the sales tax is not going to work.  So what other alternatives are there for Ebay?

Not true.

They just collected from a single sale of $100 from me to Nebraska. THEY ARE NOT even collecting for them and will not be required to collect or pay that tax they collected. https://revenue.nebraska.gov/businesses/sales-and-use-tax/notice-remote-sellers-and-marketplace-faci... my total for 10 years here selling to NE is 100 dollars!


The Nebraska Legislature recently enacted LB 284, clarifying that remote sellers (those without a physical presence) selling tangible property and services subject to Nebraska sales tax must obtain a sales tax permit from the Nebraska Department of Revenue (DOR) and begin collecting and remitting Nebraska and local sales tax if their retail sales (all sales other than resale), including sales made through a Multivendor Marketplace Platform (MMP), in Nebraska exceeded $100,000 in the previous year or current calendar year, or if the seller made 200 or more separate Nebraska retail sales transactions in the prior calendar year or current calendar year.

You are incorrect. Ebay was not "forced" into anything of the like. Most sellers never reach the thresholds of those states looking to correct. If Ebay collects and the sellers does not reach the threshold they will just keep that money AND paypal will charge a 3 percent transaction fee ON THE TAX never paid to anyone.

For instance, today they charged a sale of mine ($100 item) sales tax for Nebraska and no tax is warranted and no law forcing Ebay to collect tax on a yearly sales of 100 bucks to Nebraska. https://revenue.nebraska.gov/businesses/sales-and-use-tax/notice-remote-sellers-and-marketplace-faci...

You just simply misunderstand.  Ebay has been responsible since May 1st of 2019.

We all pretty much call this a Sales Tax issue, but in reality is is a Use Tax when you purchase from out of state or out of country and bring it into your state.

 

The definition is: Use tax is a sales tax on purchases made outside one's state of residence for taxable items that will be used, stored or consumed in one's state of residence and on which no tax was collected in the state of purchase.

 

Most states that have a sales tax also have a law regarding Use Tax on the books.  The problem is they never found a way to enforce it and most residence were not voluntarily complying.  So last year with the Supreme Court overturned some older rulings that prevented taxation of internet sales, states were very excited.  

 

Now these states also have minimum thresholds that a seller need to sell to people within any given state before sales tax / use tax is required.  This presented a big problem for states as they knew that a whole lot of potential income for them was being left on the table by the volume of small sellers on various Marketplaces like Ebay.

 

So the states came up the Marketplace Facilitator Laws [MFLs] that put the onus onto the Marketplace as a whole instead of the individual sellers within the Marketplace.  This guaranteed that all sales on the site would qualify for taxation when shipped into a state with an MFL.

You might note that Ebay charges SELLER the tax and puts it on the transaction. Therefore the SELLER has to meet the threshold NOT THE MMP (Multivendor Market Place) Please read how Nebraska handles this https://revenue.nebraska.gov/businesses/sales-and-use-tax/notice-remote-sellers-and-marketplace-faci... You will see it is the SELLER, not the MMP that has to reach a threshold. Today Ebay collected over $7 on a sale to nebraska from me and paypal charged me 21 cents to give it back to paypal WHO DOES NOT HAVE TO PAY AS I HAVE NOT PASSED THE THRESHOLD!
