SCAMMER BUYER ALERT!!! Asked for return and Got refund

Hi everyone, I’m so angry now and this is my situation! 
This buyer bought a Tiffany & Co. 18k yellow gold letter C disc on 15th July. She made offer and I accepted but she didn’t pay immediately so I had to send a reminder. After that I got paid and shipped the item out. I even pay out of pocket to upgrade the shipping from 1st class to priority! My bad that I forgot to record the video before shipping 😠 After the necklace was delivered, she asked for return as “not as description” and you know for this reason, Ebay’s always on buyer’s side. I tried to contact the buyer and asked her why she said the item’s not as described?? NO ANSWER! Then I think ok it’s fine, I accepted  the return and had to pay for return label as well.. 

The package was delivered yesterday but I just checked it out today. I was shocked because when I opened the package, there’s a old wallflower plugin instead of my necklace!?!! WTH??????? Fortunately, I recorded the video right the moment I started opening the mail box! 
I refused to return and asked Ebay to step in. I got their email with declaration form and said they’ll investigate!!! But I also just got email from them said that the case was resolved and they’ll refund to buyer as the package was delivered?????? 
My question is even when I proved that the buyer is a scammer, Ebay doesn’t do anything about her??? And she still got the refund with my necklace??? 
I think this is not her first time doing this!!! She knows she will get the refund with the item no matter what! So scared!!! Be careful everyone!

Hello everyone, it’s me.. again ☺️ 


First, I would like to say thank you to all of your information and advices. They meant a lot to me. I’m so sorry I cannot reply to everyone because there’s alot 😅 

Second, I’m so happy to inform that I WON THIS CASE!!!!! woohoo 🥳 I really don’t know if it’s called “Seller Protection”? After filling the declaration form and sent to Ebay, I just got the result tonight that I would receive the return of fund. I’m not sure if Ebay have to pay the fund out of their pocket or they’ll charge the scammer buyer but I really hope that it would be option 2. Cuz she’s definitely not deserved the refund and my necklace!!! 😠

 

In my declaration form I said “I can provide video recording from the time I opened the mailbox and unpacked the package! Also I believe my apartment complex has video recording the mailbox so I can prove that there’s no one touching my mailbox after the package was delivered until I opened and recorded it which as mentioned above!” 

 

So I just wanna say, if you feel any suspect activity from the buyer, please record the video carefully right away when you start packing your products and when you receive the return package (if buyer asks for return). Because who knows if these videos can help you take back your money? Maybe I’m lucky this time but this would be a big lesson for me!

You can't name and shame on this forum, your posting will be edited shortly by a mod. 

 

I'm sorry your path crossed with a scammer. That's very unfortunate. Videos mean nothing, you can't prove the video is actually of what the buyer returned, which is why eBay won't consider it. Your only option is to notify the authorities on this person. You have all their info and you can file a police report against them. It may work to deter this person from doing this to someone else. Best of luck to you....

Never sell something on ebay that you're not comfortable giving away for free.   You have absolutely no seller protection with managed payments. 

 

Your best option is to tell the buyer you intend to contact their local police department.   Report them for mail fraud to the government, and then file a small claims court case against them and sue them.

 

Also keep a watch out for when a class action lawsuit is filed against Ebay over this issue, and join in on the fun when it happens. 

 

Ebay just got nailed with a massive lawsuit over the harassment news, just a few days ago, so they're going to get used to paying out large sums in lawsuits until another company buys them, or they end up in bankruptcy court.

I wish I could find the post where a member here drafted a perfectly worded message to a buyer such as yours.

 

Something along the lines of :

I received your package today but unfortunately someone has removed the iem and relpaced it with rubbish.

I have of course reported this to the postal service and will be also filing a police claim tdmorrow as this is postal fraud.

The Postal service and police have been given your contact details and will be contacting you shortly with a case number so they can garner information needed to bring the thief to justice.

blah blah

 

Probably won't work but if it causes a headache for the buyer, so be it.

And what a stirling recommendation for eBay as a selling platform!!

I totally agree with you but it just should not be that way - sellers afraid to list because they may get scammed while eBay does nothing to protect us.

Ebay isn't the venue to sell expensive items.  Just wait and see what scum of the earth appears with the wedding ring. 

 

The address isn't even a 'trailer park', it's a campground.  Buyer lives in town where purse is for sale.  The purse is likey scammed too.

eBay does not consider videos of mailing to to be proof of anything. If they did, then unscrupulous sellers everywhere would make videos of themselves shipping a Rolex when they really didn't ship it. 

 

Fortunately, I recorded the video right the moment I started opening the mail box

eBay does not consider videos of reveiving a return to to be proof of anything. If they did, then unscrupulous sellers everywhere would make videos of themselves opening an empty box whern it really wasn't empty .

Put them mmediately on your block list. Message them telling them you are fully aware that they have stolen your expensive necklace and that you are filing postal mail fraud charges with USPS. Tell them to return the goods or the mail fraud filing will proceed.

I love how people give excuses for the scammers by saying things like you agreed to ebay's policy or don't sell something you can't afford to give away for free.  I highly doubt this is their Saks 5th Ave account.  In such a case I don't think ebay can sit idle and twiddle their thumbs and mumble something about only being a forum.  They're the ones who need to be on the phone with the FEDS.  No not the police but the FBI. I realize some sellers do scams too but 9 times out of 10 the buyer is taken advantage of a "venue" who could care less.  When have they ever implemented measure for returns by perhaps forcing them to be opened by a postal worker,  taking their word for it and siding with the seller?  That's just a simple,  albeit tedious solution but they've never had one,  neither did paypal.  Just look at the promo this site was running,  sell your STOLEN looted $100 sneakers and pay no fees.  They're not a safe harbor venue,  they're complicit by essentially running a fencing operation.  I just picture the police telling sellers it is a civil matter.  Corporations are out of control along with the banking sector.  They created the monster all out of GREED.  You can also add to the mix state legislators all around the country are making such crimes a misdemeanor now.

You can also appeal the case that was a closed in the buyers favor. But first, file police reports in this persons town, and the mail fraud report. Submit these reports to ebay on the appeal. Their automated system wil naturally favor the buyer. It;s a lot of extra work but if this person is out to scam other sellers out of expensive designer jewelry be proactive to stop this stuff here. Best Wishes and hope you get some resolution.

I am thinking that is they are doing very well on these authenticate programs and that since the CEO Jamie Ionnone is really excited and see’s some real good these programs are doing that they should really be expanding these  to get all these expensive designer items into a safe program that would attract more sellers to sell these things on here  and get ebay more profits with out the dreaded fear of the current state of affairs.

The buyer committed mail fraud, so you think the right move is for the seller to do the same?
