I sold a phone and in my listing I stated no returns. The buyer received the phone and then filed a return request stating that purchased the wrong phone.
Now in the return request I have the option to decline the return. It also states in the request to please atke action by Dec. 13th.
My concernin is if I decline the return I will receive negative feedback.
My question is, what happens if I don't take action by Dec. 13th? Will the return be automatically approved by Ebay or will the option to escalate the return to Ebay be offered?
I would prefer to escalate it to a claim because I believe I will win and any negative feedback should be removed.

Phones and low feedback are scam targets, it may be best to pick RETURN FOR REFUND and make sure you get the same phone back. If they do return it , it may not be the same one you sent or they may go away. Buyers may leave a NEG for anything.

I don't think this is a scam, I think the guy just changed his mind.

If you don't take action - Ebay steps in - the guy keeps the phone without returning it - Paypal refunds the buyer the money and you get a case closed without resolution strike which would probably mean the end of your Ebay selling career.
Best to start with low cost items in non scamming categories rather than ipads, computers, gaming systems and phones which tend to be high dollar scammable categories as the buyer realize most newbies have no idea what the are doing or how to fight scammers.

Not sure about the return request, is it an open case? No Returns is a target also, the buyer may be refunded and keep the item if you don't respond as you don't want returns. Hope someone will jump in with some info.

Ok, so your sure that if I don't take action then Ebay will automatically approve the return and issue him a refund? There will be no opportunity to escalalte this to a case?

If the buyer asks eBay to step in, then they are escalating the case. BUT this is a remorse return and if your return policy is "no returns", I don't think the buyer can ask eBay to step in and even if they can, eBay will not issue them a refund and let them keep the phone. That is only on SNADs when the seller refuses to accept the return.

You could be correct, they may have sold it on another venue. But the sellers my have been nervous of being scamed by a low feedback buyer also. And after a few negs it made the rest nervous.

It's a remorse return. It's not a case. If the OPs return policy is no returns, then it is completely false that he will get an unresolved by seller defect.
