Refund with eBay

I am currently fighting the seller and eBay for my Money.   The seller said that they did not receive their item.  Granted with the backup of the USPS it did not get there quickly.  But I did not offer a certain shipping time frame on the shipping.  But now the buyer has received their item, and eBay refunded 100% of the buyers money.  Leaving me without my products and without my money.  This is unbelievable.   eBay is not allowing us the seller to manage our customers.  I hate thief's We the sellers on here constantly have to deal with eBay and the the buyers.  I am hiring a lawyer to deal with eBay.  I do what I say I am going to do for my customers.  I hardly have issues.  But eBay is allowing people to be criminals.  Which makes eBay an accomplice to this.  I hope people ready this and make their stories be known on here so that it is documented and eBay and the buyers can be held accountable.

Trust me I am fustrated as well by packages taking so long to get to the customers. It is a tough situation.

Ebay is trying to keep buyers happy as well. You buy something for Christams and you still have not received it after christmas. Of course they are going to contact Ebay for their money back. And yes sometimes Ebay does give it to them. I have also had this happen. And then to make things worse. You see that the package ends up getting delivered to the customer. Yes if the customer is a good person they would contact you and give you a chance to send them a label to get your item back. But most of the time they dont. I think at times they believe they deserve the free item because they had to wait. At least thats what they convince themslves of. They seem to forget we are just like them and are just people trying to make a living and are not trying to take advantage of them as well. In all of this I am not sure who is to blame for all of this USPS deliverey nightmare.

Is it really Ebay's fault. Probably not. What do we want them to do. Tell all buyers if you dont get your item your out of luck. NO. Is it our fault for shipping items when we knew it was going to take a while. No. I think at this point its just the way things are. We just try to keep reassuring customers that we are working on the post office to find their items. We keep communicating with the customers becuase thats what angers them the most when we ignore them. And above all be nice and polite to the Ebay staff when woring with them on not arriving cases. How much would we want to help someone yelling at them. I have been selling on Ebay for twenty years and hope to for many more. I dont wnat every day to be a struggle to list. Sometimes we just have to accept what we cant change and move on. Hope everything works out for you.

Make sure that you are getting a lawyer that is paid only if you are paid.  I don’t really see any sales from you that would warrant an expensive lawsuit.

Make sure to show the lawyer the User Agreement you agreed to when you signed up for eBay.

The User Agreement that you agreed to says you cannot sue eBay or its affiliates....

At the height of slow shipping, in December I had about 20 items more than 25 days in the mail. About 10 buyers did "not received", and so after 10 days of no updates on tracking I ended up refunding 10 items. And after a week suddenly tracking updated "as delivered" except for 2. Yes I am out of money and out of my items. But on a positive note I wake up each morning. Nothing you can do about this. These rules are enforced by law.

Did the buyer receive their item BEFORE eBay refunded them?

 

I do what I say I am going to do for my customers.

 

Don't you tell your buyers that they will receive their orders or do you just tell them "I'll ship it and then you are on your own".

Have you tried asking the buyer to send payment? If yes and they refuses you can sue them in small claims court, but if it is a low dollar item it isn't worth it. Twice I had a lawyer friend send a demand letter and that was enough to get them to pay. If you have a friend who is a lawyer that is where I would start

Not to mention eBay has staff lawyers and you'll go broke while loosing the case to them.

i had ten pkgs run late and i just kept up with the tracking and explained  the situation to the buyers from a to z and we waited and we waited, and guess what, they all got their pkgs delivered  within the last few days, all except one, and  i told her today i would refund her and  she tells she can wait, that she knows its not my fault and  that she trusts me because im a very good and honest seller. think she might be a repeat customer? oh yea, shes been waiting since dec 19th.  repeat customers is the secret to killing those INR  cases. like anything else in life, your reputation for doing something  extremely well will precede you.
