Thanks for your reply ebay needs to look at its buyers more clearly if they,ve been using it it's been working so should there problem but I understand what you mean but it's just frustrating as il be out the refund and even if they do send the phone back they say it's now faulty so I get a broken phone that left working and in excellent condition either way I lose.

How do you know they have been using it? I could easily let it just sit there for two weeks and not touch it until someone made me try it out. My husband bought me one and it sits in the bedroom for months at a time never turned on until he asks me about it.

Just curious.
"Broken" as in it doesn't work?
-or-
"Broken" as in It was run over by a truck?
If they've been using it for 2 weeks and they claim it doesn't work, you're stuck with the return.
If they've been using it for 2 weeks and now it's smashed in 100 pieces, you MIGHT be able to get ebay customer service to side with you.

A buyer has to use the phone to determine whether or not it properly functions ... sometimes, there are faults that might not show up in the first week or two.
With respect to electronics, the Money Back Guarantee is effectively a 30-day warranty ... the device has to function properly for 30 days.

You are assuming that the buyer is being dishonest. But, consider that there will always be a point when a phone just stops working, even when we've taken good care of them ... sometimes they just meet their demise ... it is their time to die or break.
What buyer would be happy with a phone that breaks after 2 weeks? Who is it that should "lose"? Should the loser be the buyer, the seller, or eBay?
Well, eBay gets to make that decision since this is their site. Now, understandably because they are in charge, eBay has decided that it is NOT going to be eBay that loses ... eBay also considers sellers to be plentiful, and buyers to be much more valuable ... so, it is the sellers who "lose" when something like this happens.
That's just the reality of eBay.

Or you could get a perfectly good phone back because they just didnt like it or needed the money for something else.
Bummer and hassle for you, but you could resell then
