Potential buyer fraud- New mobile phone

Hi, just after some advice please.

 

Just sold a brand new factory sealed mobile, and delivered to the buyer today.

I checked the tracking and saw it was delivered this afternoon. I messaged the buyer to say I saw the phone had arrived and I hope he is happy with his purchase, and please can he leave me positive feedback.

I immediately received a message to say that he had already emailed me with photos of a scratch on the top left hand corner. I replied and said I had not received the images and please can he resend.

While waiting I have called ebay to report as a potential fraud as I received the mobile last week from my work after winning in a competition( major high street retailer so no way it would be damaged)

Ebay advised you report buyer and block from purchasing again, that they could not see a message with images and to wait for buyer to open a case before they step in.

Buyer has now messaged again saying have i received their email with photos of what has now became “scratches” instead of a scratch.

I have request they send the photos via ebay as not seeing them on ebay.

 

I am quite certain this is a fraudulent attempt and once a return has been requested and accepted i’m likely to get a replacement handset masquerading as mine? phone retails at £1170 so not cheap.

I have also complained to paypal but can’t do anything until a case is opened.

I have images of the box so have imei and serial number so could in theory get a phone shop to check once they are open but don’t know if ebay will overrule and refund anyway.

 

Would really appreciate some advice?

You are going to have to wait to see if the buyer files a return request.  In the meantime, it is recommended that you don't do this anymore:

 I messaged the buyer to say I saw the phone had arrived and I hope he is happy with his purchase, and please can he leave me positive feedback.

 

Here in the US, we call it "poking a sleeping bear".

You’re right I never thought of it like that, was just anxious as never sent something that costly on ebay before!

 

I wonder why he keeps saying emailed the pictures rather than sending them on ebay? I’ve read on other threads if buyer opened a case and you refuse return due to no images of damage you will lose and they will get a refund? Maybe that’s what he’s hoping for?

It must have been on a different ID than the one here as it shows no listings, no sales.  If it was a new ID, you were just asking for trouble as you would be a scammers delight.

I would not have messaged them at all. Some people don't like the extra communication. I don't but that's just my opinion. 

When you say he already sent photos but you did not get them...maybe he has you mixed up with a different seller. Maybe he bought more than one phone on Ebay.

Buyers are NOT required to provide any documentation regarding the condition of the item or their dissatisfaction of same.  Here, email addresses are not shared between members so, a buyer could typically NOT send anything  directly to a seller's email client.   It is basically the ebay message system or nothing. 

 

If the buyer files a return for a "not as described" reason, and you don't accept the return (and provided return shipping label),  eBay can decide to refund the buyer from your proceeds and let them keep the item as well.  It does not matter if the reason chosen is the truth, only that it was selected.  Of course, the buyer can return anything they like, and you still will be refunding.   This will be the same regardless of your return policies. 

Do check the rules specific to your country, however.

Any buyer can steal any item from any seller at any time by filing a fraudulent dispute. This has been true since eBay introduced the Money Back Guarantee in 2008. 

 

Unfortunately, no one here can tell whether it will happen to you or not - and no one here can give you advice that will prevent the possibility of it happening.

 

It would certainly be an expensive lesson if it did happened.

There's always an exception to certain cases. I message my buyers who I put a signature confirmation needed, if I see it's OUT for DELIVERY, and message this:

 

"A head's up. A signature is needed for release, but probably NO actual signing because of Covid, only a person is there to receive the package."

 

Never had an issue, a few even thank me for the heads up on a signature is needed.

 

But I agree NEVER message the buyer requesting a FB or massaging the buyer and asking how they like the item, or asking for a rendezvous. 😛

NEVER message the buyer requesting a FB or massaging the buyer and asking how they like the item, or asking for a rendezvous...

Noted that you have exchanged messages and your buyer is claiming that he has sent you photographs that you have not received.

 

I assume he has not said that box was open or anything similar and at this stage we must not jump to conclusions as it is always possible that item was scratched during production/ assembly or some substance has gone on during packing that looks like a scratch.

 

In my experience there is little value when and if you receive these photographs but asking for these is important as less experienced fraudsters may get scared and stop.

 

If and when your buyer opens a return and reason stated is Not as described or damaged  I am sure you already know that you have no option other than to accept a return and a pre paid label will be offered by eBay (At your cost)  or you provide a label and hope that item returned is yours and as you fear not a switch.

 

if item is switched as you fear then I am sorry to state the obvious but refund must be issued and you can report the buyer as abusive on eBay.

 

I don't expect eBay to do anything as they never have sight of what sellers send or buyers return.

 

As for Pay Pal I can not see them doing anything even if your buyer makes a charge back claim as all they will do is ask the buyer to return the item via tracked& signed service and when tracking shows item is delivered then they will issue a refund to buyer and debit your account. Pay pal take the same view as eBay that they did not have sight of what you sent and what buyer returned.

In the event that you become the latest victim of online crime then only option available to you is to file a crime report with your local police station as this is a growth area and most police stations have a dedicated team to deal with this crime. No doubt police are underfunded and under staffed to deal with such a heavy workload but you never know they might just go and knock on your buyers door and if phone is in his possession then you would have had a result and he would have a criminal record.

 

at this stage I would just sit tight and I would respond to all of buyers messages but as briefly as possible and I would not get involved in an argument. If he asks for a partial refund then my advice would be to agree to this amount and tell him that as per eBay's policy he must open an INR case and you can refund through this case.

 

Tactically this protects you from buyer opening another case and as you haver already agreed the amount then on the case  itself you have an option to offer a partial refund which buyer accepts and case closes immediately with buyer getting the agreed amount and Pay pal is notified that a partial refund has been agreed and he will now have great difficulty in opening an item not as described case on Pay pal.

 

My apology for such a big post but I wanted to cover as many eventualities as possible.

 

Let us hope it doesn't turn out to be complicated.

Thank you.

The buyer has messaged again asking if I have received the images, which of course I have not.

I’m having some health issues at the moment and really can do without the stress.

Is it unwise to tell them I haven’t received the photos and confirmed with ebay none have been sent, and to ask what they wish to do with the phone?

My advice would be please don't invite a return at this stage.

You have already told your buyer that Photographs have not arrived.

Most you do is send a message saying none received.

eBay only see the same messages that you see and they do that by going to your account.

eBay do not intercept messages between sellers and buyers.

Please consider logging out of eBay to give your self some relief from this stressful situation.

You don't have to deal with this immediately or as and when your buyer requires.
