Photo Ownership

Have laws changed on using other business and corporate photos to sell items even when they are the same item? I always thought this was illegal to use someone else's photos and have been noticing a lot of sellers doing this... If someone could clear up the rules on this, that would be great. Thanks.

Copyright laws have not changed. 

 

But the rules on eBay have changed: 

 

What should I do if my image or text is being used by another member?
When you create listings you give eBay and it's members permission, through our user agreement, to use your images and product details. Your content may be added to the eBay product catalog, and may be used by other sellers in their eBay listings.

If it is a new item it doesn't make any difference. They all look the same. If it is a used item the seller is taking a chance of a inad claim because any flaw in the item could be different than the picture.
