I was curious i am in a situation that i have to give a partial refund for a open return so after the refund if buyer chargeback with by CC then ebay would cover me.

Not a lot of details. What kind of situation are you in that you have to give a partial refund for an open return? Generally when a buyer returns an item they are fully refunded by the seller unless it is a remorse return. Did the buyer actually open a case and if so how did you respond. Are you attempting to handle this with the buyer outside of an official claim process? If they opened a case have you issued, or has the buyer obtained, a return shipping label?
Difficult to answer the chargeback question without knowing some more details about the current situation.

First, I usually never grant a partial refund. If I do it is because I know I have made a mistake of some kind and not the buyer making any false claims about an item in order to obtain merchandise AFTER THE SALE, for a discounted price. If They are making false claims I tell them return for full refund. Chargebacks can happen for any reason including AFTER you do a partial refund. They can go back to the chargecard and ask for a the full amount and in some cases the item is not even required to be returned once the CC company get;s involved in this stuff. So the answer is, YES, if the buyer wants the full refund after you do the partial they can still go to the card.
