I am a long time Ebayer since 2005. I have near 600 feedbacks with no negatives. I am having trouble with a seller who sold be 2 sports cards. Long story short they sent the sports cards in a flimsy padded envelope. The padded envelope arrived damaged with a huge tear in it. The seller has been accusing me the entire time of taking the contents out after arrival and as being a scammer. eBay has a process and I originally filed for item not received which was the incorrect filing as it was received but was received damaged. I than called eBay and was advised to file for a refund for contents received missing or broken. I even went to the local post office to report the damage and sent the seller pictures. Even after all the negative things the buyer has said and have received ZERO help besides accusations that I am trying to scam them I am at a loss of what else to do. It’s the principal of the matter and the cards were $300. What does EBay usually do in these cases? The envelope was damaged in transit and the contents were missing. I have started the refund process and explained what happened with pictures and have to wait until April 1 to request EBay to step in. In the meantime I get negative accusations and messages from the seller that if I have a problem it’s my job to contact the post office not his. I have had almost 600 transactions on eBay and this is the first challenging one. Hopefully I can recover my $$???

As long as you are not lying. And I am not suggesting you are.
Its the sellers problem not yours. Stop communicating with the seller
and when it is time ask eBay to step in and you will get your money back.

Sellers like this give us all a bad name. So now just wait a few days until you can ask eBay to step in. You will get your refund.
It is unfortunate your time was wasted in opening the wrong case. Below is a link to eBay’s Money Back Guarantee policy. It is important to know your rights here.
Remember also you can leave appropriate feedback regarding this failed transaction. Keep it factual and don’t mention the case. If you do, your feedback may get removed by eBay as that is against policy.
I recommend ceasing all communication with the seller except thru the case. It is highly regrettable this member has made unfounded accusations. It sounds like they have been burned before by real scammers. But that is no excuse for their behavior. It sounds like they need to learn how to best package their goods to endure transit. If their messages have been profane or threatening, you can report that poor behavior to eBay.
Good luck to you and please hang in there. One bad seller out of 600+ transactions is a good run. Sadly bad sellers exist, but most people are honest and forthright, thank goodness. So sorry this happened to you. Link below to the MBG.

@cardoptix Stop all communication with this seller. You are not required to contact them and you can see that it leads to nothing but more stress on yourself. As long as you opened the item not as described you will be covered. Just follow the correct procedures for that INAD case and be patient. You've purchased from a platform that offers a MBG. Ignore any further messages from this seller. Best of luck to you....

............... one more thing. If you are buying, and selling on the same ID................ STOP doing that. Some sellers are vindictive, and will take revenge actions even when they are at fault.

I am a seller and am disappointed that you find yourself in this situation.
In defence of your supplier all I can say is that he must have been hurt by abusive buyers and he has gone ultra defensive. As communication has taken a nasty turn I would stop communicating with seller.
I hope you had realised that package was tampered with when delivery took place and if you needed to sign then you made sure that this fact of tampering was noted on the delivery signature.
It may seem odd for a seller to give you this advice but you come across as a genuine honest person and if you were my buyer then I would accept your claim.
Please open a case on eBay qualification being that you ordered 2 Pieces and you only received 1.
I think correct term / type of case is Missing parts and you can look this up on resolution centre or types of cases.
I would not expect your Seller to accept this case and after a period case can be escalated and I would expect eBay to close the case in your favour with a refund and they may decide not to debit the seller. you should load the envelope showing tear on the case as evidence.
If you have not already then please send the seller photograph of actual package showing damage. This evidence will then be available for eBay's return team to view.
You don't need to contact postal service provider as they will only answer to Sender and not recipient, however if your seller makes a claim then they may contact you to confirm what happened.

It sounds like you simply need to do two things:
a) wait until April 1 and ask eBay to step in
b) don't let the seller's messages bother you

I will start by saying that on ebay, the buyer ALWAYS wins but!!!
You as a buyer have to know your way around the system.
For this reason I am going to suggest keep this discussion board handy, and feel free to come here to ask for help with any monetary / transaction issues that you are finding bothersome.
Further you may wish to read up on the particulars of INR vs INAD and so on, also always check the seller's return policy before making the purchase, and make sure you know how the MBG relates to it (and if you don't, these folks here can help).
