the seller shipped the item and I am to get it soon,,, she recently told me that it DOES NOT come with the console itself,,,, I am planning to return it since I believe that is misleading ,,, do you think it is not as described and I could force her to do a return,, even though it says she doesn’t do returns, please give me ur option, most sellers who don’t include the actual switch say it in the description,

I am not into gaming so I have no frame of reference, but if the ad was misleading, then yes, it is not as described. After looking at the text, it does say both Switch and Console, so I would agree with you. It should have been spelled out plainly in the description. So after you receive the item, open a case for Not As Described in the Resolution Center. The seller must refund. Good luck.

On the one hand they never listed the console in the included items. "from the 2020 released Nintendo Switch Console Animal Crossing Edition" does not mean it includes the console.

On the other hand, the box pictured is for the complete bundle- dock, extensions and console- and it was listed as like new. If they removed the console that should have been clearly disclosed.

The seller did a bad job with the listing- it was unclear at best, intentionally misleading at worst- so I think it qualifies as a SNAD.

Be sure to accept the package- do not refuse it. Then open a SNAD case. The seller will have to provide a return postage label and then refund in full upon receipt. Do not close the case, no matter what the seller might say or promise, until the seller has received it back and you have received your full refund.
