No Digital Copy

I sold a bluray/dvd/digital copy set. The set didn’t have the digital copy intact anymore, but obviously the case still says digital copy.
I didn’t mention the digital copy ANYWHERE in my listing (the words DIGITAL COPY) aren’t anywhere in my listing at all, which also means I never mentioned it was included (also never mentioned it WASNT) and now the buyer is upset there’s no digital copy included.

Am I out of luck and have to process a refund/return, or am I in the right as the digital copy was never mentioned in the listing whatsoever (not even in the title of the listing)

Is it "mentioned" in the pix of your product (i e. on the product itself)?

 

Yes, you can sell without it.  But you have to notate the product states it on the blu-ray, but no longer viable.

I only checked one of your listings since you did not mention which was the problem. The Disney "The Sword and Stone" says right on the package that it includes a digital copy, but you never let buyers know in the description that the digital copy is not included.

Make sure the buyer knows it is not included BEFORE you ship the item.

If he/she is ok with that, then fine, go through with the sale and ship it.

If they are not ok with that, then cancel the transaction.

The buyer will get a full refund.

Then you can re-list it, this time with the correct information. 

Learn from your mistakes.

If the box says a product includes something and you're selling it WITHOUT that something, yes, you need to make that very clear. Otherwise the buyer has ever reason to expect that they will be getting what is written on the outside of the product.
