Need Revised 1099-K

I'm another one of the surprised recipients of a 1099-K for 2024. 

But my issue is the name (and SSN) used on the form is incorrect. I have updated my seller account since receiving the 1099-K, but there is no way to generate an updated form.

 

A call to eBay support seemed to be productive- but an hour later I was told to "contact a tax professional." I'm not positive but generating revised/updated tax forms is a pretty common occurrence in the real world. 

 

Has anyone else run into a similar situation? Or know a way to receive an updated 1099-K?

They got your SSN incorrect? Not just your name?

 

You don't actually need to generate a new form if the data (Gross Income, etc.) on the current one is correct, since that form is simply telling you the amount(s) that eBay has reported to the IRS; i.e. it is really a report to you, not them, and you don't actually mail in the 1099-K itself, but in general I would want to make sure that the SSN gets corrected in future.

 

If eBay really did report the wrong SSN to the IRS, then it will probably bounce back sooner or later, and I would not want to be trying to fix things after the fact with the IRS.

If the name and SSN on the 1099 is what you had in your eBay profile for all of 2024 I highly doubt eBay will revise the 1099.

 

This is probably why they suggested contacting a tax professional who could advise you on how to deal with this type of situation.

 

eBay cannot and will not provide sellers with tax advice.

At that link they give this unhelpful advice for OP:

"if the information on the form is wrong, contact the issuer of the Form 1099-K immediately. The issuer's name appears in the upper left corner on the form along with their phone number. Taxpayers should keep a copy of all correspondence with the issuer for their records."

 

Since eBay won't fix it for 2024, just prepare your return as if the SSN and name were correct.  It is the amounts that are the most important.  If your return includes the income on the 1099-K, you are golden.  If you ever get an inquiry from the IRS, just show them that the income in included.

Ebay will and has revised 1099Ks as needed.  This OP needs to get in touch with Ebay.

That is an assumption NOT a fact.  Ebay will revise 1099Ks that are incorrect.

Why were you a "surprised recipients of a 1099K"?

 

I'm unsure how you "called" Ebay as they no longer have the traditional Call Center.  You do need to get in touch with Ebay so that you can get a corrected form.

The person whose name and SSN are on the 1099-K needs to report it on their 1040 as being incorrect. If they don't, the IRS is likely to assume they didn't report the income, and assess them taxes on the full amount. They should indicate as shown below left, in a few words, why the amount is incorrect, and if possible who (name and SSN, or business name and EIN) the 1099-K should have been sent to. Then, you need to report the income on your appropriate tax return form, as though you had received a correct 1099-K.

 

These examples from the IRS may not be exactly your situation, but they show you what you need to do.
