I was just informed that I can not say Native American in the title for the Native American jewelry I am selling 

as it is discrimination!

Native Americans are proud of the exquisite hand detailed jewelry their people have produced. I have collected it for years. It is in no way derogatory to describe it as such. I think eBay is totally wrong with this policy. 

It may be time to look to other sites to sell this jewelry where it can be properly described.

What are we susposed to describe it as? Indigenous American Jewelry?

Are the pieces signed? If not, you can call them Southwestern pieces.

What exactly is the message that you are receiving from eBay?  Please show us the exact words.

 

Many of us use the term "Native American" in our listings, without raising a problem.

 

It's possible that you are seeing the standard, boiler-plate warning about selling "Native American" items, and you are unsure of how to continue.

 

So please show us the message that you are receiving.

@graciecollects   They inhabited the North American Continent when people came here from Europe ... maybe Native North Americans would be a more accurate term.  I am not aware of how they are referred to in Canada ... Native Canadians?  Of course they did not come up with the country names ...

Does the listing tool accept tribal affiliation? A few years back I recall creating some listings for turn of the century Post Cards with Native American images and tribal affiliation (or some to that extent) was an Item Specific on the listing tool.

You can NOT imply something is Native American made without a certificate to prove such, OR unless you have a BIA card. If you don't know what a BIA card IS, then you don't qualify to sell things "Native American". 

 

It doesn't matter IF you bought it straight off the reservation from the craftsman, you need something more than your word to prove your claim. There are tight regulations and rules around these items for a reason. 

 

Not everything sold by someone who is or MAY be Native American, is actually MADE by a Native American. Keep that in mind. 

 

You may not like it, but that's the way it is.

Yes I was happy to see Ebay crack down after that law was enacted..too much junk fake NA jewelry sold here then.

 

All products must be marketed truthfully regarding the tribal enrollment of the producers so as not to mislead the consumer.  It is illegal to market art or craftwork using the name of a tribe if a member, or certified Indian artisan, of that tribe did not actually create the art or craftwork.

Read the policy here, crolling down to Listing for Native American arts, crafts, and jewelry must follow all government regulations.

eBay, I am pleased to say, is strictly guided by The Indian Arts and Crafts Act.

First Nations is used in Canada.  The Canadian First Nations laws are more strict than those in the U. S.

The warning you are likely getting has nothing to do with discrimination.  It has to do with the Native American arts & crafts Act, that others have pointed you to.   It's also typically just a warning & does not usually stop you from listing.

Which makes ZERO sense because gift shops in the Mackinaw City/Mackinac Island tourist meccas sell beautiful pieces of Native American jewelry. Which is in Northern Michigan.
Hardly the "southwest".....
