my item it is a one of a kind prototype. No other exists:

it was denied entry to china at ebays kentucky global shipping ct (for those who do NOT use global
the item is not in china it is inspected in kentucky)
another seller has it:

he is not only using my photos he is selling MY item there is no other one...on the planet
it is a (failed) prototype designed by one man there are no others...NONE i know this as fact.
the seller also copies my description tweeking it slightly.
how does this happen?
ebay says they are "investigating," not to sound sarcastic (ok i am) that usually means i can't find a solution on my screen so i'm forwarding this to somebody else

Not sure why it would be a surprise. GSP has to pay both the seller and the buyer generally, they need to recoup their costs, the obvious option is to re-sell the item and as quickly as possible to get their $$ back at the lowest cost. They are already upside down just in the shipping costs paid back to the seller.
Using the original pictures and description is really not an issue either, they have the item, it was sold using the original pictures and description, and unless those are protected by copywrite, are basically owned by eBay and not the seller.

I understand all that. Still feels weird to me. Not saying it's technically an issue b/c I know it's not, but it feels wrong. Not so much the reselling, but the use of my pics always infuriates me.

Ok, so you sold an item. And you shipped it, but it did not make it to the buyer. Did you have to refund the buyer? Are you out money and someone else is selling it?

You like to have control over the items you sell?
You have more control over domestic buyers than international buyers as far as what they do with the items they buy from you?
I guess i'm weird. I don't care what happens to my item when someone else buys it.

GSP doesn't have to pay the seller; the buyer already did that. The seller gets to keep the payment from the buyer, but GSP refunds the buyer.
I'm pretty sure that the images still belong to the seller.

You got paid for it - Right? If so, what's your complaint? Only person who could complain would be your buyer. However, if you got paid and he got refunded by EBay, then neither of you have a complaint.

Regarding pictures you post on listings:
When you create listings you give eBay and its customers permission, through our user agreement, to use your images, videos and product details. Your content may be added to the eBay product catalog, and may be used by other sellers in their eBay listings.
You may contact the seller and ask them to remove your image or text if it is not part of the eBay product catalog.

The control will be in your mind only. Anything you sell becomes the property of the buyer, any buyer (foreign or domestic) can decide to resell the item and they could resell it on eBay.
The only way to have actual control is to never sell anything.

Same. I honestly don't understand why people get so hung up about this. The buyer can set it on fire for all I care (although obviously I hope they don't!) because it's not mine anymore. They've paid for it, they can do what they want with it.

Tend to agree I could care less what happens to an item after I sell it, or if the buyer uses my picture and description to post it for resale. What I could not tell from the OP, and they have not returned, is whether they were paid for this item. If the buyer has filed any type of claim or chargeback or if the GSC took care of the matter and refunded the buyer allowing seller to keep the buyers original payment.
OP's story has a few missing pieces.

I get why @buytodayshipnextday is a bit upset about this - first off, they didn't know about the GSP resale, nor that the reseller is authorized to use their photo/text. Second of all, it's a very rare item.
It might be good to cut a little slack here - nothing nefarious is going on, but it's startling to someone who doesn't realise that their own rare item is being shopped out.

True.
But either you want the thing or you want the money.
By putting it up for sale on eBay, the probability is that the OP wanted the money.
Which he got, although the transaction actually failed at the GSP , which would not export it.
I go through this daily with DH. We have a lot of stuff, stock from the shop we closed and retired.
I keep reminding him the plan is to turn it into money.
He wants to organize it first, even though much of it was described and priced for sale in the shop.

Very cool. I just found an item that I had rejected from GSP about one year ago. Yes, they used my pictures, and a lot of my description. Am I upset? Not a bit.
