MISUSED return request

Hello ebay community, 

I sold a FarmerTec MS660 chainsaw to a member that won it in an Auction format. He paid 510.00 for it plus 61.22 for shipping. Total of $571.22. When He received the saw he messaged me and told me that the saw was "counterfiet" and unless I send him a STIHL chainsaw he would "get the law involved" ....lol. I didnt advertise such saw, never not one time. Infact, the very first word of my listing description said FARMERTEC......MS660 chainsaw. Item specifics under "brand" said FARMERTEC. First sentance of my Description said it was a FARMERTEC MS660. 

He opened a false return request claiming "counterfiet"    In order for something to be claimed counterfiet I would have to pass it off as one thing when its another. When clearly I did not. Ebay put the return request on hold for the buyer to provide picture proof as to his claim. Well you guessd it, no pictures, not even a response. Ebay granted the return a day early. So he sent the saw back. When I reseived the saw back, he used the saw. I even provied proof in the form  of pictures. Where he left bar oil and fuel in the tank when he used it. They gave him his money back.

This transaction cost me the $571.22 owed to ebay, plus the $51.00 ebay fee, plus $6.12 for the ebay shipping fee, plus the $37.07 for the return shipping cost, plus the $36.36 for the initial shipping cost. Now ebay forced the fees through my bank and made it go negative so another $30.00 fee. 

So this transaction cost $731.55, that of wich $160.55 actually came out of my pocket.  When ebay should have never granted the return in the first place. I have ebay recorded telling me that "it shouldnt have been done, but there is nothing that we can do about now the return has been started" They even told me that it was buyers remorse, I have a MANAGER telling me that, After the fact OF COURSE.

 

What can I do, I am a single Father that was disabled 15 months ago with permanent nerve damage down both my legs. Having a spinal fusion surgery Aug. 30, 2018. Building these saws is my ONLY income. So having this wrongfully granted return really hurt me.

 

Please help with suggestions

If you got the saw back, you are not out the $510 for the sale..i wish you good luck on your surgery.

Sorry this happened to you.

 

I would stop using the word "Stihl" in the title, and other places in the listing.

So sorry this happened to you.  Were very glad you got the item back.  They can return for any reason they can think up it dont matter and there is no way to prove your case with the current system.  Block the buyer so they cant come back.  You can also report this person for damaging the item before it was sent back.  Other than that your limited as to what you can do.  Best regards

It`s not a question of your honesty. It`s been suggested not to use Stihl in your listing to

A) close the loophole where your buyer claimed it wasn`t a Stihl

B) avoid ANY confusion

C) keep your listing from possibly be shut down by ebay.

 

Many buyers don`t read the description or can`t because they are using cell phones. The same for pictures. Your description isn`t cellphone friendly. If you want to let potential buyers know it has a Stihl part that is one thing but your ad mentions the brand many times for whatever reason. Protect yourself as best you can and don`t use the brandname.

OP, unfortunately other than not listing the item there really wasn't anything you could have done to avoid being scammed.  Likely since you got back a used saw, the dude just needed it for a one off project, so the reason claimed for the return  was never the issue.  There's no protection from that sort of scam.

I think you did the right thing in ending the relisted item. 

 

If you relist again, don't use "Stihl" in the title. There's no need plus it avoids any issue a potential buyer might have. 

 

First make your description easier to read, then in the description, state facts about the saw. Just state (ONCE) that it isn't Stihl but does have (whatever) Stihl part. 

 

To keep reusing and referring to Stihl borders on KWS and will frustrate buyers looking for a Stihl brand item.

Your original listing is very deceptive. You're selling a chainsaw in the Stihl colors with a Stihl model number and putting Stihl in the title. I disagree with most of the way eBay treats sellers but you are 100% wrong here and in my opinion I side with the buyer. That is a legitimate money back guarantee claim.

Fwiw, buyer was shipped a new saw and returned one that he'd used.  *If* there were issues with the title and / or description they didn't stop him from using the saw and then abusing the MBG to get a full refund.

Yet when you relisted it you say it's "new other", and used the same photos from your first listing.

 

If it's used say so, and retake the photos, or this is going to happen to you again.

i'm sorry, but if you think "Stihl" belongs in the Title, but "Farmertec" does not, this will not be the last time you will be forced to eat a return.

Stop using Stihl model numbers too.
