Hello I have a question since I haven’t sold many items and that expensive I had a first problem today I sold a diecast car it was brand new I shipped with almost 30 dollars of bubble wrap and made sure the diecast that was inside a foam that was thick almost 4 inches thick as well it was in new condition and the buyer is claiming the item arrived scratch and demands full refund who protects you here if you send it in perfect condition as described in pictures

The buyer filed a claim with eBay? If they have, you need to know there is no seller protection for any claims that say the "item is not as described". It is only the reason the buyer chooses that counts. It is deemed by ebay to be the "truth" even if it is not. Your description and photos no longer matter at that point.
eBay controls the money, and they don't want to look at any of your evidence. They want the buyer to be "happy".
Once the buyer files a formal claim, you have two choices:
a) Accept the return, provide the return shipping label and refund when you get something back. Understand it doesn't matter what is sent back to you. You are required to refund anyway. If you choose this option, your buyer may never ship the item or anything back. If that should happen, you won't be responsible for the return shipping label cost, nor a refund.
b) Refund the buyer in full and let them keep the merchandise for free.
Though it may seem like you are having to make a choice of a taking the proverbial "poke in the eye" or taking a "poke in the other eye", if you don't go along with the program, ebay is going choose a or b above for you and at your expense' You also get the defects that go along with refusing to play the ebay way called something along the lines of "case closed without seller resolution".

I'm so sorry but you got one of those bad buyers. It's a problem when selling anything online. Once a buyer opens an INAD case the seller will lose. Your best bet is to have them return for a refund. You will need to provide a return label and just hope you get back your car. If you do get it back then simply relist it and it will sell to a better buyer. Try to stay positive and limit your time with this so you can go back to selling. Many times being a new seller makes you a target for scammers so sell more and build up your feedback. There is almost nothing you can do as an eBay seller when a buyer claims an item is not as described (whether the claim is true or false). The best thing that you can hope for is that you got a remorse buyer who is just saying what they need to say in order to avoid having to pay any shipping costs and get a full refund. If you got one of these remorse buyers you will usually get the same item back in the same condition. If I encounter this type of buyer I add them to my BBL because it is dishonest to claim INAD to avoid paying shipping costs.
On the other hand there are buyer looking to get free merchandise and they will keep your item and send you back anything. These buyers will provide eBay with a package tracking number and once eBay sees that tracking number has been delivered (no matter what is in the package) they expect you as the seller to give the buyer a refund. I would definitely add these buyers to my BBL and report them to eBay. In addition you might want to file a complaint with IC3 (Internet Crime Complaint Center). You can file a complaint if you believe you have been the victim of an internet crime. You can also file a complaint on behalf of someone else you think might have been a victim of an internet crime.

This was listed as new and from the pictures does not appear so. Moving around in the box can cause small scuffs unless it's secured and sealed up in original protection, clearly it wasn't; it was pictured as loose. It would not have come from the manufacturer like that. It would have been secured and protected in the box. How many times was it taken out of the box and 'looked at' in the past 13 years? Are you the original owner, do you even know? Just because a toy has the original box does not make it brand new. This was a product from 2007. Opening it, removing it from the packaging and handling it leaves marks and small scratches on the surface of the product. The box had significant wear too, look at the edges, you can tell it had been opened many many times. Just because a child didn't 'play' with it does not make it brand new.
You have to sell defensively. This should have been listed as used. Accept the return and relist it.

Either you have an honest buyer who is not satisfied with his purchase or you have a scammer.
The first is the easiest to deal with.
Tell him to return the toy for a refund "I regret you are not happy with your purchase. Please return it for a prompt refund."
No return-- no refund.
If he returns it refund his entire payment-- and relist the item.
If he demands return shipping, tell him to open an eBay Dispute, to keep the record straight. You don't have to tell him how to do that.
EBay will either tell you to send him return shipping or will give him a label and charge you for it.
If he uses it to return the car, refund his entire payment-- and relist the item.
If he doesn't, he loses the Dispute and you keep the payment. The cost of the unused return shipping label will eventually be returned to you.
If he is dishonest he will not want to return the car. Let him scream and yell. He has to open that eBay Dispute and go on record.*
No return, no refund.
All of which can be done through the Resolution Centre, with no human being involved.
Worst case, is the guy who returns something other than what you sent. That's a matter for Customer Service. Which can be erratic.
*Note that a buyer with a track record of "too many" Disputes and Claims loses the use of the Money Back Guarantee.

If I may suggest, change your returns policy from "Does not accept returns" to "30 days free shipping" since you have to refund either way when a buyer doesn't like it.

For $290 a byer expects like brand new without a single flaw. Your description is very vague, you need to mention every little flaw and detail that could possibly be wrong with the car when listing an item high priced such as yours. You're describing the outside packaging that you shipped it in. It does not negate the fact the car could have moved around inside the original box. I am not sure about the close up pictures, but the car does look used with a few marks on it. I assume for that kind of cash the buyer is just being very picky. Have the buyer return your car for a refund. Do not return the $$ until after the car arrives back to you.

I'm a big ole tomboy who loves, loves, loves diecast... and this just makes me want to cry.
So far... your customer hasn't requested a Return, so sit tight. The buyer may just be fishing for a refund. I agree with @toysaver that the error was made in posting 'New', so if you learn a lesson at all... that's it. I also don't like to refund without a Return, and you shouldn't either . I find that if an item sells once, it will again.
I can see from your listings that these are from a great collection. Sorry this is happening to you.
