Item description

I bought an item that was listed as "New: A brand-new, unused, unopened, undamaged item in its original packaging (where packaging is applicable). Packaging should be the same as what is found in a retail store, unless the item is handmade or was packaged by the manufacturer in non-retail packaging, such as an unprinted box or plastic bag."

 

The item was received loose in a box with no manuals or retail packaging. I contacted the seller and requested the description be changed to "New other: A new, unused item with absolutely no signs of wear. The item may be missing the original packaging, or in the original packaging but not sealed. The item may be a factory second or a new, unused item with defects."

 

The seller replied that they are allowed to use the "New" description because that is the way they receive the items from the manufacturer. I feel this is grossly deceptive and would like to contact ebay to ask them to have the seller change the description but cannot find an appropriate way to contact ebay concerning this issue. Not requesting a refund or return, just accurate non deceptive description of an expensive item. I thought I was buying an item that was new in retail packaging and it was not.

While I agree if you're used to seeing this item in a retail package it doesn't mean it can't also come to a seller in some kind of wholesale/bulk state too.  As a seller I personally would always note if there were no retail box and explain further to be safe...IMO every seller should do this but it's a choice...  Unless you work for the manufacturer how are you to judge?  You could ask the seller about how there is no packaging if that might make you feel better.  If it's that much of a concern to you request a return and be done with it. 

I've purchased a few "new" items with no retail box but am content to see some sort of factory seal since that's what's shown in the pictures.  If your seller pictured a box in the listing you'd have a great case but if he didn't it's hard to argue you didn't get what was advertised...

The seller did have the manual in the photo, though .... not that you probably can't download  it.

Without the item being in sealed, retail packaging I have no idea if the item is actually "New".

Honestly, I'm not saying you're wrong, so don't that. I think the issue here is that eBay has taken it upon themselves to say that "New" always includes a box or packaging, when clearly it doesn't.
