I bought an item that was listed as "New: A brand-new, unused, unopened, undamaged item in its original packaging (where packaging is applicable). Packaging should be the same as what is found in a retail store, unless the item is handmade or was packaged by the manufacturer in non-retail packaging, such as an unprinted box or plastic bag."
The item was received loose in a box with no manuals or retail packaging. I contacted the seller and requested the description be changed to "New other: A new, unused item with absolutely no signs of wear. The item may be missing the original packaging, or in the original packaging but not sealed. The item may be a factory second or a new, unused item with defects."
The seller replied that they are allowed to use the "New" description because that is the way they receive the items from the manufacturer. I feel this is grossly deceptive and would like to contact ebay to ask them to have the seller change the description but cannot find an appropriate way to contact ebay concerning this issue. Not requesting a refund or return, just accurate non deceptive description of an expensive item. I thought I was buying an item that was new in retail packaging and it was not.

Without knowing what the item is, are you sure it is something that should come in a box like would be found in a store? Sometimes manufacturers do ship wholesale items in non-retail packaging. It's hard to say what you need to do without knowing what the item is.

If that is how they receive it from the manufacturer, then the description is correct.

I have to disagree. Ebay's definintion of "New" condition states it can be shipped the way it was received if the item "was packaged by the manufacturer in non-retail packaging, such as an unprinted box or plastic bag." I did not receive it in an "unprinted box or plastic bag". The item, which was contained 2 separate components, was shipped loose in a box with no manuals or manufacturer's documents as it comes in the retail package sold in stores. It was in a USPS Priority Mail box.

What is your point of contention though? Do you feel the item isn't going to last as long as one in the retail packaging? Did you pay the price quoted at home depot? If not then perhaps the discount is due to the item not having the retail packaging, would you rather have paid 30 dollars more for some packaging you were just going to throw away?

How does that change what you bought? Do you feel that you didn't get a good deal, but would if the seller changed the description?

eBay has a system in place that allows a buyer to return an item (at the seller's expense) if the buyer thinks the description is not accurate.
eBay does not have a system in place that forces a seller to modify his listing because the buyer thinks the listing needs to be modified.

Patlandia. As I stated in my original post. I'm not requesting a refund or return, just accurate non deceptive description of an expensive item. I thought I was buying an item that was new in retail packaging based on the seller using the "New" condition description and it was not. Without the item being in sealed, retail packaging I have no idea if the item is actually "New".

You can't force the seller to change the new condition description.
If I felt I had been deceived, I would file a not as described claim and neg the seller.
You don't want to return the item, so just forget about it, nothing else you can do.

Well how is the sellers feedback? Perhaps you can glean some indication that they are selling what they say they are by other feedback by other buyers who actually use the items they buy, I still didn't get an answer on what you paid though? If it's less than home depot then the packing shouldn't really be relevant otherwise you would have paid the home depot price.

OP, where is the seller and where did the package come from?
You might want to reconsider sending it back as it might have come from the manufacturer that is making counterfeits of high dollar merchandise.
I'd file a snad return request and see what happens.
