Is this a violation of the abusive buyer policy?

1. Buyer orders 200 of a product sold by size. Size options (in inches) are 1/4, 1/2, 3/4, 1, 1.25. He chooses 3/4 inches 

2. Buyer receives items, contacts me saying "they aren't large".

3. I say I don't sell "large". I sell by inch (sizes above)

4. Buyer says I ordered large and I didn't get what I ordered, what are you going to do to make this right?

5. I try to establish with buyer that he ordered 3/4 inch size and he received 3/4 inch size

6. Buyer says he wants me to ship him 300 more of the item "to make it right".

 

After I gave him a bunch of options, not including shipping 300 more, he opened a return for "Doesn't Match Description or Photos".

 

Did he violate the Abusive Buyer Policy? (see red below)

  • Requesting the seller ship to an address other than what you included in checkout

  • Requesting a partial refund without returning the item
  • Request additional items or services not included in the original listing or asking for a discount
  • Finding an item on eBay and taking the sale off eBay

That would be news to me and the hundreds of people selling feeder insects in pet food, reptile supplies, and probably other categories. Here is a category of live insects.

You may get away with it because of a technicality of the wording the buyer made. In fact though, the buyer was right. Your title read small, medium, large, and extra large. If the buyer thought they where getting large and got 200 medium you owe him the difference. That is what the buyer is saying. He is not a scammer as most people here think.

But that makes no sense. Purchase is by size in inches. Description is in size by inches.  I even say "These are sold by the following sizes: 1/4, 1/2...etc"

 

"Large" is a value judgment. Connecting "3/4-inches" to "large" is as random as connecting "1.5-inches" to "small". They make equal sense...ie...no sense.

Pets and most live animals aren't allowed on eBay. The few that can be listed must follow our policy.

What is the policy?

Sellers can only list the following live animals:

  • Bees, crickets, and ladybugs
  • Domestic (not exotic) aquatic snails
  • Fertilized eggs (species must be included in the listing description)
  • Live bait such as minnows, shiners, earthworms, and mealworms
  • Lobsters
  • Mice sold specifically as food for pets
  • "Stud" services (including but not limited to dogs, cats, horses, sheep, goats, and cattle)
  • Tadpoles
  • Tropical fish

Pets and other live animals not included in the list above are not allowed.

 

Specifically says bees crickets and ladybugs are the only insects allowed. No mention of roaches. Just because other sellers get away with it doesn't mean it's allowed. Plenty of listings for face masks too.

Correct, That is why you need to immediately go to all your listings and change it. Your buyer was correct even though confused. Give him more, or have them return those bugs.

Okay, I looked at the listing. You have five sizes in your picture and a choice of 4 actual sizes to choose from. Some people are gonna think 1" is Large. You should correct the listing and do "something" for the buyer. Then there's the other issue........

Did he buy from the listing that has this title?

Actually, seven sizes of roaches in the picture, with five fractional sizes below those seven roaches, with four sizes in the title and the variation menu. Then, down in the item description, four descriptions of "small, medium, large and extra-large" again, but the five fractional sizes.

 

I'd say this listing is kind of a hot mess.

OK, fine, my ad isn't perfect, but he ordered 3/4 inchers and got 3/4 inchers. The purchase size is as explicit as it can possibly be.

But you're not suggesting cockroaches are "Live Aquarium Intertebrates," right? That was just highlighted in purple for some other reason, correct?

I see what buyer is talking about. In the title the sizes are : Small....Med....Large...XL

 

In the drop down menu sizes are:  1/4.....1/2.......3/4.......1"

 

Buyer matched each size word with each size measurement from smallest to largest as it listed in title and drop down menu

 

Small=1/4"

Med= 1/2"

Large=3/4

XL=1"

 

Buyer chose 3/4" because he interpreted 3/4 as being the large size

when he got the bugs, he was expecting large because thats the size he felt corresponded with 3/4"......he thought 3/4" would be larger seeing as, according to his interpretation of measurements, 3/4" was representative of large

 

Thats how I think  I wouldve interpreted the measurements with sizes

Judge not others by your own limitations
