I just did a search on what an item was going for. Search Item xxxxxx, in this listing and most of the seller's other listings he includes a "sold out" at a reduced price. I would think this is a listing violation, but not sure which one.

I see what you are saying. He is advertising a much lower price in his variation listings to attract more buyers. That low price makes it seem that is what he is selling his Nike Air Jordan's for, as opposed to his actual much-higher price. This is Search and browse manipulation. As for the policy, i didn't see an exact violation for this unethical bait-and-switch pricing, but in general terms, this is what eBay says, and it seems to apply:
"...Not allowed

Not sure if it is or not.
If anything, the easiest way to get any results with this seller is to contact the nike vero team. They guard their shoes closely.
What I am getting at is this seller is selling Nike shoes worldwide. What some sellers don't know is you cannot sell certain Nike shoes in certain countries that those shoes haven't been released(basicly copyrighted in) in yet. Look up Nike under the vero program. Not sure if it is still there but they used to explain it there and better than me.
Certain designs are released in certain countries. You can resell Nike in any country that design was released in but not a country it hasn't been yet.
Anyways this seller is selling a wide range of Nike shoes worldwide so I bet they are in violation with Nike.
Whenever I sell Nike, I keep it to my own country. Yes, I lose extra money from other countries but my problem is I never know what county that style of shoe was ever released in so I play it the safe way.

It is. It's Search & Browse Manipulation.
The inexpensive item isn't a sneaker size choice. The seller deliberately named it SOLD OUT to keep people from buying/choosing that option, but SOLD OUT isn't actually sold out

I agree he is gaming the system with this. On the other hand he does have one available for the variation called sold out. So a buyer could buy the sold out variations and file not as described when they receive there item if they wanted to or the seller would probably cancel the transaction and get an out of stock defect.
Good Luck Selling!

^^ This.
From time to time, Nike goes through eBay and not only gets these "worldwide" listings removed, but they apparently have such influence with eBay that the account in violation will get permanently banned.
And (agreeing with others), it is a listing violation ... we see it frequently with overseas sellers, particularly China sellers who put a $2 box in the variation along with their $30 item.

This is why I think it is better to go thru this route. Go thru ebay about listing violation, they will tell you they will look into it and might or might not do anything. But if you let Nike know, they seem to have a better push with ebay.
Or you could just avoid this seller and let it ride out. Like Orange said, Nike takes a trip through here quite often and will eventually catch up to them.
The seller is also located in Lithuania. makes me wonder if the shoes are really Nike? Might be another violation.

It is search and browse manipulation. In theory everyone on this thread could report the item.

Not sure if you know or not, but there is a report this listing link on the right side of the listing page. Just didn't want you to have to call CS if it isn't necessary! Saves you time this way.

Seller already has 1 neg and 1 neutral regarding the search/price manipulation. "SOLD OUT" is the dropdown option title they are using on the lesser priced item in the variation listing. I didn't know SOLD OUT was a shoe size. Am I that size?
Their feedback in 95% (out of 280 for the last 12 mos - 13 negs/12 neut)
