I sold a fire extinguisher to a customer for $29.95.

Kidde's recall of 40 million fire extinguishers was announced on Nov 2. Every online big box stores including Amazon has pulled their listings...except eBay. I went through and reported about 50 listings thinking that would get eBay to realize what was going on. I also messaged them through Facebook and got a response yesterday saying it would be forwarded to the dept in charge. Needless to say the faulty fire extinguishers are still listed and some have sold in the past 3 days. If someone dies because the extinguisher that was bought had been recalled and doesn't work, someone (including eBay) is going to get sued.

I am sure ebay has covered themselves somewhere in the agreement you sign that they would not be responsible.

Actually a lot is listed on ebay, especially toys from the 1950s, 1960s that would never pass muster today.

I'm not sure how that title got above my comment, but I didn't sell any.

http://pages.ebay.com/help/policies/recalled.html

"Before you list an item, take a few minutes to check the manufacturer's website and the US recall information website to get information on recalled items. We recommend that you also sign up to receive email notices about item recalls.

You can also learn about the federal law on recalled items called the Consumer Product Safety Improvement Act.

Buyers should also keep up-to-date about item recalls, especially for the kinds of items they often buy."

Looks like Ebay is telling both buyers and sellers to do their own due diligence, and as every single Ebay listing states, "Seller assumes all responsibility for this listing."  Any liability would fall on the seller who listed the item.

The easier you are to offend the easier you are to control.

Guess we'll wait for the mainstream media to pick up on the fact that it isn't safe to buy products from ebay as they will allow recalled items to be sold.

Re: I sold a fire extinguisher to a customer for $29.95.

I am just curious, did you report the 50 one at a time?

I would have just called Ebay CS and told them to search (whatever key words you used) and let CS report them all.  If they didn't want to do anything, or gave you excuses how they couldn't do anything, then that is their stance.

Ebay makes it seem like each has to be reported individually but that certainly is not the case.  Confederate flags and 2001 ground zero debris was all taken down PRONTO.  A Listing went up and an the listing came down almost immediately, after the initial deletion of all of the listings that were up prior to the decision these items are not allowed.

Relax.  It's the weekend.  This looks like it was just announced Thursday.  While it covers a lot of models, it doesn't cover everything Kidde ever made, so they can't just exclude all Kidde models.

It's going to take some time for the lawyers and the web techs to figure out how to exclude only the affected models.

Did you cross reference the models and codes on each one of those listings to verify they were affected models?  Were you even able to clearly see the code sequence on each listing you reported?

Right, Emerald, and every listing states:

Seller assumes all responsibility for this listing.

This is located right above the description.

Don't forget the vintage Corningware percolator coffee makers as well.

If it works, sell it. If it works well, sell it for more. If it doesn't work, quadruple the price and sell it as an antique.

Only sellers are responsible for what they list.

eBay specifically prohibits the listing of items that are the subject of government recalls.
