@traintrack_man It doesn't matter how many items you sell. All the 1099K form is, is a form that eBay is required to send to you if you sell over a certain amount due to IRS rules. I believe it will be $2500.00 for 2025 unless congress changes it.
Any sales you make need to be reported as income, even if less than the minimum for receiving a 1099K on your tax forms and then you deduct your expenses, Cost of goods, eBay fees, shipping etc. from them to report any profit/loss. You are only taxed if you make a profit from your sales.

1099-K is based on your gross income - not the number of sales. You declare ALL income and then take your deductions. The 1099-K simply tells you what gross income was reported to the IRS by Ebay under the law.

It doesn't matter how much you sell or how little you sell, you're still are required, by law, to report any income gained from selling, regardless if you receive a 1099 or not.
It doesn't necessarily mean you will pay taxes on those sales, you still are required to report it.
If you don't report your sales to the IRS you would be committing income tax evasion.

There is NO limit on the number of transactions. The threshold for getting a 1099-K is based only on your total sales (including item price, shipping and handling). If you sell just one item and the price is over that threshold amount, then you will get a 1099-K and thus will not be able to avoid paying income tax on your eBay sale(s).

There is no number of items. It's $2500 to receive a 1099 in 2025 period! In 2026 it will be $600.

There is no limit on you reporting your income.
Report your income like you're supposed to and you won't have to worry about getting caught.

@traintrack_man You could have 1 sale for lets say $200.00. You are still required to report it as income on your tax forms. You also are allowed to take any deductions to offset that income.
You have been a member since 2002 with over 2.8K transactions. I really hope you have reported all that income over the years. An IRS audit would not be any fun at all if you haven't.
The 1099K amount is just a trigger for eBay to send the form to both you and the IRS. What the IRS needs to do is just remove the minimum amount and have all 3rd party processors, (eBay, Etsy, PayPal, Amazon, Uber, Door Dash etc) report all sales no matter the amount.

There are so many similar posts here from people who don't want to pay income tax on their eBay income. Does that mean they have no other income like a regular job, investments, rentals etc on which they's be required to pay Federal income tax?

Getting the form simplifies your work at tax time.
It gives you a base number to make your deductions from.

Don't worry about the 1099 as the IRS already can see the number of sales you have made. Everyone can see it = 2.8K. It's all right there in our feedback. Just report what you do every year and you never need to worry about extra paperwork coming to you. The 1099 is a good thing as it lets you know how accurate your figures are.
