How likely I will win this "doesn't match description" case?

Recently I sold a remote attachment, which adds TV control to an Android remote:

In the listing, I put a note "Nvidia Shield remote not included".

 

The buyer just opened a "Doesn't match description or photos" return request with comment "item was shown with remote. i want to return item".

 

If I ask eBay to step in, how likely I will win this case?

I can't read white print on chartreuse. Was that the plan?

Tell the buyer to return the item for a full refund.

If he opens an eBay Dispute you will be told to provide return shipping.

You can do this through the PP payment.

When it returns, refund him.

 

Not every transaction will go perfectly.

When you relist the item -even if it has been unboxed you can still list it and get some of your costs back-- don't use a picture of a remote that won't be included.

 

Use only the picture that shows what the buyer will be getting.

 

Your no refunds /no returns policy is unenforceable. Sensible buyers will bypass you and crooks will ignore it.

You'll lose and ebay will rule for the buyer to return the item back to you for a full refund... which will be the exact result if you approve the return. Except you'll avoid a penalty for closed without seller resolution and probably avoid losing your FVF.

You won't win it.  Accept the return, send the return shipping label. Refund when you get it back.

 

If you ask Ebay to step in, you will get a very nasty seller non-performance defect, the buyer will most likely get to keep the item and they will get a refund since by not accepting the return you are saying that you don't want it back.

The easier you are to offend the easier you are to control.

Not applicable

You will loose.  Disclosure is insufficient.  Take it back and refund unless you think getting a defect is fun.  When & if you relist make it more obvious in your listing title, pictures and description.

 A "note" will not suffice. It has to be in big, bold letters, underlined in caps and bright red font.   Unfortunately you have to "idiot proof" your listings so that a 5 year old can understand it.

Whatever you do, don’t ask eBay to step in. Ebay will side with the buyer 95% of the time. When they step in and favor the buyer, you would also lose your Final Value fee credit, and receive a killer defect on your account. So it is generally not in the seller’s best interests to withhold the refund in a Not As Described case.

By the way, it is not a good idea to say in your listing that you will leave the buyer a positive feedback once they have left a positive for you. It is a policy violation of the Feedback Manipulation rules to reference feedback in the title or listing description.

 

In addition, it skirts the feedback policy that states eBay will restrict sellers from including conditions or terms of sale that could interfere with a buyer leaving feedback. Links to those two policies below:

How likely I will win this "doesn't match description" case?

 

Sellers post here almost daily to report that buyers have file disputes where the buyer is clearly mistaken or asking for something unreasonable.  

 

Very rarely does one of those sellers post a followup saying they had actually won the case.

Optionally you can issue a refund now and let the buyer keep the item.

Considering the box the item comes in shows it attached to the remote I really don't blame the op here.  The box says attachment for the remote it's not meant to have the remote. Unfortunately you do have to idiot proof listings and need to put in big bold writing it's the attachment only that comes in the box
