Buyer opened return - item not as described / wrong item received & uploaded a photo of his computer in my box.  

 

Item 2018 Mac mini $1549

 

Accepted return

 

Received 2009 Mac mini (Value around $150).  

 

This was returned with elements of the packaging from the 2018 Mac mini.  So, I know he received the correct computer & simply stuck his computer back in the box and returned it filed as wrong item received.  

 

Shipped UPS signature required / Shipped on time / Have original purchase receipts with serial # (return serial does not match)

 

Haven't yet clicked "ask eBay to step in and Help".

 

Sent e-mail to buyer yesterday asking if he mistakenly put the wrong computer in the box --- No reply --- He's been careful not to say anything, but "Wrong item sent ---want my refund"

 

What do I do at this point?  Contact eBay first or complete these first?  Have until the 12th to refund or open case.  

 

File USPS Mail Fraud Complaint?  (returned via USPS)

File IC3 Internet Crime Complaint 

Open case with his local police dept

 

100% positive feedback 12 year seller with a history of selling $1000+ items daily.

Also have your local pd dust the computer for prints. The buyer put it in the box and probably was dumb enough to handle it.

1. Using your computer's serial number, report your sold computer as stolen to both the police and manufacturer.   With your police report, tell the manufacture should that computer get registered, they are to contact XXX police office. 

 

2.  Get the serial number off the returned computer;  contact the manufacture to see if that computer can be traced back to your buyer.  If you are able to get that computer traced back to the buyer, get all the necessary paperwork and put eBay, PayPal and the police on notice.   

 

I am not an IT pro, but, I believe you should be able to track the owner of the returned computer.

So glad that you had resolution in this case. Just a thought going forward, would enabling "Find My Mac" be helpful in a situation like this? You would be able to track it to the buyer or thief in this instance. With Find My Mac, you can locate and protect your Mac if it's ever lost or stolen. To use Find My Mac, simply turn it on in System Preferences > iCloud. You need to set up Find My Mac before it goes missing. In addition to all of the above I would definitely go on social media and shame this guy in front of everyone. It is not slander or libel if it is the truth and you have proof that it is. I'd also be tempted to go to the news in his town with the story. But that's me. I'm like a dog with a bone about injustice and thieves.

Awesome so glad you had a satisfactory result to your dilemma, sadly many don't have such success even with valid proof of the wrong doing. Considering all the evidence you recovered I would contact their local police department and ask if they would like it forwarded to them to do an investigation. I would definitely provide Ebay with the information and they should be giving that buyer a permanent ban! Who knows how many sellers they have wronged. People do eventually get caught, sadly it's after they've ripped off tons of sellers for lots of money before action is finally taken.

Getting the local pd to dust for prints is like pulling teeth. Not easy.

My car was stolen years ago. Cops would not dust for prints. Never did, & never found the offender.

The case was put on a 10 day hold and then eBay closed the case 3 days later in the buyer's favor & I received absolutely no notification of this.  Called, filed an Appeal and received an e-mail stating I would receive a full refund by replying with a copy of the Police report.

eBay replied with a full refund 3 days later.  

 

Posting to this message board got me an invite to eBay's concierge customer service.  I believe this was one of the single most helpful factors in obtaining a refund.  The concierge service is what calling eBay should be for every single user with short wait times and customer service representatives who are authorized to make decisions and effective change.  

 

On a side note I did do a complete file recovery of the buyer's returned 2010 Mac mini.  The buyer erased & shipped the computer with a fresh install of Mac OS, but here is a list of the types of information I recovered:

 

Tax return / W-2 

Social Security Number

Prescription receipts / Medical information 

Adult photos / Adult dating site e-mail history 

Family photos (spanning decades)

E-mail database

Messages from previous scams including him returning the wrong item & signing multiple sworn affidavits on "stolen mail" from amazon, eBay, and others.  

 

I really didn't even dig that deep (there's 600gb of data).  The information left was crazy.  

 

Buyer has been scamming for at least 9 years.  The address is a single family house with a street address and when he gets "caught" or has his accounts banned he just adds an Apartment number.  I found e-mails where his address was Apt. 1, Apt. 2, Apt. 3 and so on.  

 

Ebay covered this one.  Thanks everyone for the help and information.  This was the most concise and helpful list & these are the basic steps to follow:  

 

1. Open an mail fraud case with USPS

2. report fraud with ic3.gov (maybe FTC complaint also)

3. File a report with your local Police Dept and insist they forward a copy to the buyer's local PD.

4. Report the buyer for abuse on eBay using the new links to report abusive buyers.

5. Call eBay and upload all the above documentation.  Try asking for Trust and Safety when calling.

6. If eBay finds in the scammers favor, open an appeal and repeat the previous step.


Sorry that you had to go through this nightmare ..... and shocked that Ebay did the right thing .... but congratulations on your success !

 

Based on the information that you found on the returned computer, your police department and / or the buyer's police department might now take an interest in the case, especially since the data documents multiple crimes.

 

I would also call the USPS 800 phone number, explain the whole story, and see if they can forward your call to the "Postal Inspector Department" ( or whatever it's called ) ...... because, they too, might get more aggressive in investigating your case as well as all of the other fraud documentation that you found on the  returned computer.

 

Maybe your County Sheriff or County District Attorney would take an interest in the case because of all of the information that you found on the returned computer.

 

In my opinion, the information that you found on the returned computer changes EVERYTHING.

 

It is no longer a matter of "he said / she said".

Yes, you have way more than the usual amount of evidence seen when some mope tries a switcheroo scam. This particular goofball has accidentally handed you a mountain of evidence regarding his past scams, not just this latest one, and the sheer quantity puts your case way ahead of a one-off scam.

 

You should definitely make this known to his local PD, preferably by phone call (just ask for any detective for starters). Be patient, because their first reaction will probably be to put you off; you'll need to have a short, clear explanation of what you found on the machine that shows far more scam activity beyond your immediate case. Some larger PDs have a cyber-crimes officer or two, so you might want to ask about that up front. Good luck and keep us posted!

Yes, oftentimes I've seen on the news or internet articles about guys like this who were found to commit multiple online scams.

 

Great work OP. Just think once convicted, you'll help thousands of other sellers from becoming a victim of this human garbage. A heartfelt personal thanks from me. We all appreciate it.

Wow, that's the mother lode of information and sure beats the proverbial "box of rocks" some sellers get! I'd be tempted to print all that out and send it as a dossier to the "buyer's" address and/or workplace-or local newspaper etc. sunglasses

Had something similar happen to me, I sold an autographed picture of Jimmy Hoffa, complete with verified authentication. The buyer claimed the autograph was false/forged, and promptly sent it back to me for a refund. I opened the package, and there was a picture all right, but of someone pleasuring himself with a farm animal! I promptly messaged the buyer and asked for the name, address and telephone number of his local police dept.  When he asked why, I told him I was filing charges against him for mail fraud, etc. He then told me the picture I received was sent to me accidently and was supposed to go to someone else "as a joke" He told me he was happy with the Hoffa picture, end of story!

Thank you for the information and sorry you went through this. I used to sell things on ebay back in the late 2000s, but have been scared to lately because I'm not try to get ripped off. I'm always scared someone will either return me their broken item for the good one I sent, or even use a hot air gun to change serial numbers and send me back a broken item.
