Hope someone can help me
I sold a Laptop for $1500 buyer claims he got an empty box. I called Fedex to start a claim because buyer seems honest and has good feedback. We go back and forth messaging to be patient with me until I hear from Fedex. Buyer gets inpatient files a claim, so I provide the tracking and emails from fedex. I told buyer in ebay resolution chat that its impossible that a box weighs 8 pounds is empty. I call Fedex to see if they can give me weight of package. They said it weighed 8 pounds throughout shipment.
Ebay rules in favor of buyer, I get in a letter from fedex saying that they can only refund me $115 bucks because I did not insure for the complete amount. Im confused because fedex claims did not explained what they found. A Fedex rep says it weighed 8 poounds throughout the shipment if thats true why fedex give me a check if thats true?
Now I am upset and I want to sue either ebay or fedex. I want to contact ebay again! tell them it weighed 8 pounds throughout shipment and it can't be an empty box but they already ruled in favor of buyer. What can i do? or recommendations?

To be honest if it was me i would bypass fedex and ebay and file a civil suit in court. And I would file theft charges against the buyer. It should fall under theft by deception and be a felony charge because of the price of the item. The weight of the box would be evidence proving there was content in the box when it was shipped. And fedex would weigh it throughout the shipment proving it wasn't taken out of the box during. The theft charge would initiate a court hearing to prove it was the buyer ripping you off. Then the civil suit after would allow you to recover your losses. I would contact a lawyer asap.

Hello seriuss.....I hate to say it, but ALL buyers have good feedback, as sellers are not allowed to leave them any negative feedbacks. What was it about the buyer that seemed "honest" in the beginning of the sale? That he paid on time? Next time you send anything over $750 in value you must get signature confirmation, and for sure get the insurance. I'm sorry you have had to learn this the hard way! 😞 I would put in an appeal on the claim and show Ebay the FedEx info on the constant weight throughout shipment. Best of luck!

The couple of times I've had similar issues, Ebay initially sided with the buyer but refunded my money upon appeal. I don't know if this is policy or not, but is certainly worth a try to appeal. Be persistent; I've had to call Customer Service repeatedly about a single matter lately myself. Deano

Every time I read one of these posts, I ask myself WHY would anybody sell an item of that value on eBay? Make no bones about it, you were scammed by your buyer. When I sell an item that's over $350, I send it with delivery signature confirmation required. This is not the first time your buyer has pulled this. Sellers need to keep in mind that just as they have protocols and rules they followed to be a successful seller, scammers also have rules and methodology they use in their craft. Therefore, that "seemed honest" ploy flies right out the window; it is a moot point. You really can't blame FedEx as they see what happened as eBay SHOULD see exactly what happened. Even though the $115 is extremely measly, it is more of a courtesy move, should you care to call it as such, by FedEx. I agree with the advice of going the real time crime route. Although as the amount does not exceed $5,000 and does not involve the USPS, I'm not sure that the felony part of that would be accurate. But then I'm no attorney.

1. FedEx "said" you only insured it for $ 115? Is that true? If it is then that was a mistake on your part, if you have proof of a higher insured amount then use that in a Civil Suit
2. Package weight: FedEx or any carrier ONLY weighs their packages in the bulk centers, once they leave there for the local depot and then delivery there is no weight check performed, it could have been opened and resealed.
3. Regardless of the 2 items above this is a scam the Buyer is running and of course they sound honest, most con artists are very convincing. They know EXACTLY how eBay and other online venues work and are probably making a lot of money reselling everything they steal from online purchases.

I don't understand...........your thread doesn't answer the question.... I don't use Fedex.......but if USPS shows delivery, in general, they will not honor an insurance claim that I know of......... I don't know why Fedex would.

Well you didn't take the time to read it, is why you didn't understand it. I state that FedEx is not paying the full amount because they know or strongly suspect what happened. That the $115 payoff is just a courtesy move and is not actually any kind of insurance backed remittance.

I should say USPS would only honor the claim if there is non delivery OR there is damage to the box.........

You can't sue Ebay.... read the User Agreement. You have to file for arbitration. You need evidence that Ebay made the wrong decision.
What kind of laptop was it and do you have the serial number? Report the laptop and serial number stolen and call Apple, HP, etc. to ask them how to report the property as stolen. If it gets resold or registered, they may be able to locate / recover it.
This is why I always use USPS to send expensive items. If you ship with Fedex or UPS it is JUST a civil matter. If you ship with USPS and something like this happens, it's a federal criminal matter too. Scammers don't want to be on USPS radar. People have gone to prison for this....

USPS will honor an insurance claim when an item shows delivered

USPS has paid for non delivery on an item that showed delivered for me. The post master says they initially always deny these claims which is why this rumor that they won't cover it exists but that upon appeal they will. My buyer had to sign saying they did not receive it even though it showed delivered
