Full retail CDs that have read errors

I was wondering if I bought a CD and the original had read errors could a copy of the recovered CD contents be considered piracy If I include the original CD with it showing ownership of it.

 

If so I want to know, so I do not try it.

I would throw it in the trash. Yes it is against the law.
