Feedback removal

We shipped a TV to a customer by the UPS Ground. According to the tracking results, it was lost during shipping.  We issued full refund to the buyer. The buyer left a negative feedback and Ebay refused to remove the unfair feedback. It was not our fault that the UPS lost the package. This is something out of out control.

You chose the carrier, so you're responsibile for the item till it gets to the buyer and ebay isn't going to remove a neg when you admit the buyer never got the tv

@faalsh_38 As the seller you are held responsible for your item being delivered. It makes no difference who the carrier is. That is the policy on this platform. The transaction is between the seller and the buyer only. The feedback doesn't violate any policies so no reason for removal. Best of luck to you....

IMO your response was professional and the fact you put a tracking number in solidified your reply.

I do hope you are going after the carrier for compensation if you can do that over there.

There was a thread in the forum yesterday about prohibiting negative feedback whenever a refund was issued. This is one (and probably the only) instance where I would support that idea. While the seller chose the shipper, they have absolutely no ability to prevent a lost package.

 

It's the seller's responsibility to refund the buyer, but it's not the seller's fault.

The package was shipped by the UPS Ground without delay and the tracking number was provided to the buyer after we shipped it. She was able to track the package. It is not our fault that the package was lost during shipping. We issued full refund.  Reasonable buyers do not leave negative feedback without a legitimate reason. We deal sometimes with mean spirited Latino buyers and some of them do not even read or reply back to us.  We are not happy for the lack of Ebay seller support.  It is not fair.

What an unfortunate statement. Pointing out a buyer’s cultural background as a fault is a quite sweeping generalization. A buyer’s heritage should have no bearing on who is (or is not) a desirable customer.

In fact, the FTC Consumer Review Fairness/Protection Act is clear in that it does not provide legal protection for consumer reviews that contain comments about the products, services or behavior of parties who are not involved in the sales contract. In most cases, the only parties to the contract are the buyer and seller.

 

The obvious reason for this is that a seller does not have any control over the actions of a third party such as a carrier. That is true regardless whether the seller chose the carrier or not, and, although it is irrelevant anyway, one cannot assume that the seller chose the carrier in this or any case, as the seller may very well have offered various shipping and/or carrier options for buyers to choose.

 

In this scenario, the consumer has left a review, in essence, concerning the services of a third party (the shipping carrier's). Therefore the FTC act does not regard it as "covered communication",.

 

eBay does have the right to remove any feedback which is not a covered communication under the FTC act or is clearly false or misleading. Don't let them convince you otherwise.

 

This is clearly unfair, as the deficiency of the shipping carrier should not reflect poorly on the seller. In terms of shipping, the seller can only be held accountable for having shipped the product out on time or not.

For a buyer to leave negative feedback for the seller under these circumstances ... no violation but also NO CLASS.  Some people have no clue and no class. 

 

Your response to the feedback was excellent. I would have no hesitation buying from you. 

 

Continue selling. Continue providing good service. Your feedback will speak for itself.
