Both. Started last fall as I recall.

Interesting. I suppose eBay could always take the position that it's against their TOS so they have a right to invoke policies/actions that "enforce" them.
I can easily see a seller accused, saying "Prove It." Seems to me tho, it could be a rather muddy area to prove or disprove depending on what was said.
Wonder how many times eBay has actually assessed such fees or, whether it's more of a scare tactic?

It seems like I remember at least one post that a seller was charged it........ I think the messages were in ebay messages. I certainly could be wrong........

What the heck!
They put it in their UA, so it must me true and legal. Just ask them, they'll tell you.
I can just see it now - 6 months down the road, you get the bill for something that you sell that had been listed on ebay. And, since everybody has used ebay, at one time or another, you owe them.

Well, if it was a unique item and you walked in to court with the item in your hand, it'd be kind of a slam dunk that it wasn't sold anywhere.
And I seem to recall a thread along those lines .... messages were questionable, but the seller still had posession of the item and no payment had been made.

It went into affect last year when eBay started cracking down on off-eBay sales and changed the contact info policy. Several sellers here have been charged under this new policy, some were legit deals done off eBay and some were not. I’m having trouble locating the threads, I think one was on the My Account board. Thanks, jen. I would hope that when they decide to charge people for something like this that they don't leave the decision up to a bot, but on the other hand, I wouldn't be surprised if they do! 😉

Thanks, jen. I would hope that when they decide to charge people for something like this that they don't leave the decision up to a bot, but on the other hand, I wouldn't be surprised if they do! 😉
I think they do use bots but they will tell us they don’t. They Keep telling us that when a seller is restricted for off eBay sales that a human reviews things and makes the determination but there is plenty of proof that a human being is not involved in the process 😉

I am guessing their next misguided misadventure will be to create a bot script that scours other eCommerce sites (Etsy, eCrater, Bonanza, etc) looking for titles that match or nearly match those of anything that ended here within the past 60 days with no sale, and start sending out invoices to the sellers here whose titles matched what the bots found, whether there was any communication about the item or not.

According to eBay, that's why "real people" review/make a final decision on various issues. At least that's what we've been told to believe... 😉
