Last month we have sold a Cisco Module worth 3000$ The buyer opened case as DOA after 20 days and sent us back a Dell Battery in the place of module and the ebay genius Customer Support has refuned the buyer all 3000$ Now we lost the card as well as item. There are lot of scamsters here, earlier also several times it happened, but the items were under 50$, so we never bothered, this is a big scam and that some people take advantage of return policy is which is totally biased for buyers and screws the sellers.

File a complaint with the USPS Postal Inspectors - they take a dim view of using the mail for fraud.

File a complaint with IC3 - every complaint, whether acted upon individually or not, adds up.

File a police complaint - I think that this is more than petty larceny, in most places.

File a complaint with the FTC - they have an 800 number and are easy to reach (in my experience).

 

Perhaps with copies of those, you can open an appeal of your case with ebay.

Not saying 'NO' doesn't mean 'YES'.

The foolishness of one's actions or words is determined by the number of witnesses.

Perhaps if Brains were described as an APP, many people would use them more often.

Respect, like money, is only of 'worth' when it is earned - with all due respect, it can not be ordained, legislated or coerced. Anonymous

In addition to the excellent advice from gracieallen01, and even though you also spoke with customer service, be sure to also report the buyer using the "Report a Buyer" link in Seller Hub or in the dropdown on the sold item page.

I can't add any better advice that you have already received.  Well - there is one thing add to your BBL list. 

 

I just wanted to tell you how awful it is that you are having to deal with such a high dollar suspect forced refund. Pretty soon good sellers will refuse to sell any item they cannot afford or stomach to give away and/or items that are expensive to ship and cost more that it is worth to pay for a refund of the item plus shipping both ways.  

 

I hope you are able to get a fair resolution to this situation.

Here's my anti-theft device

 

USPO

 

I pay for a po box - I stand in line like every other person and get a paper receipt

I go there daily so all the workers know me - when I have a return I always open it

at the counter in front of the clerk.  If it is a case of postal fraud they are more than

happy to fill out the fraud report with me. In 20 years I have only had to do this 1

time. And it did work out in my favor.

 

If it is fraud I also put them on my BBL - file a report with their local PD. Then I google

earth their address to see if it's worth it to me to fly there or drive there to take them

to their local court.  In your case I'm thinking $3,000 is worth it

Forget resolution or any kind of help from them. When I called them, the Protection Manager, admits that the item is still with the buyer, but he cannot do anything, as the seller has sent several messages that the card is with him, and upon that ebay has put a restriction on my account that I will not be able to list anymore, how worse can it get ?

In this case, no need to chase the Postal Department, as in the last message from buyer 2 days back also, he admits the card is with him, ebay customer support has read all his messages, in over 10 messages, he says, the card is still with him.

Contact police and the US Postal Inspectors. They stole from you, period. Punish the thieves because eBay certainly won't!

I'm sorry this has happened to you, but at the end of the day eBay won't be of much help. Don't give up and be strong, $3,000 is nothing to sense at. Your best bet is to follow the advice below:

List one: 

 

1)File with your police jurisdiction
2) ask your police jurisdiction to get the police in the delivery jurisdiction
3) Pull all information on delivery data and address
4) Google map the delivery address and if a single family home look at property records
5) When the detective from the delivery jurisdiction contacts you give them everything including eBY messages
6) Have the detective get in touch with eBay for law enforcement
7) Tell the Detective you will press charges
😎 Have the detective find out if there are multiple eBay iDs associated with this address or ID (In general there will be )
9) you may have to explain to Detective and to the DA in delivery jurisdictions how eBay works, how seller protection works etc (Many think selling on the net is the WIld west)
10) COOPERATE FULLY WITH LAW ENFORCEMENT
11) these theft continue to happen becasue people give up and do not persue becasue its time consuming and hard. Persue it legally
12) Once the Detective has made contact have the item retrieved.

 

List two: 

Ok here is the steps when an item is stolen whether through ebay return fraud, CC chargeback paypal return fraud.

1) print your auction/sale
2) download images

3) print invoice
a) print paypal invoice and payment info or your credit card processor data
b) Check the name on the CC or Paypal account may be different then buyer (sometimes 1 paypal account is funding multiple buyers) That might make this wire fraud or RICO if its a ring

4)print proof of delivery signature delivery
a) if USPS this will also be federal see if you have a NAME not just initials or scribble

5) GET GPS coordinates of delivery

6) Google map the delivery GPS (if residential home check property lists helps if the name on the tax record and customer is the same)

7) Print return label and email that shows where you sent the label (proves you were willing to take it back and they failed to do so)

😎 file a police report in your jurisdiction (Get this to ebay paypal or CC professor)

9) Once you have the police report ask that the serial number be put on NCIC and Leads online

10) ask them to get the police report to the jurisdiction of delivery ( might take some convincing)
use words like "Felony level theft"

11) If this is a watch some factories will keep known stolen items serial numbers on hand if the shows up in the service center. Get them the police report and fill out whatever form they need.

12) File an ICCC internet crime report (Provide police report #)

13) If USPS File a Postal inspectors report give serial number and delivery address (FEDERAL) (Provide police report # and ICCC report #)
a) If UPS and FED ex you can provide this but its civil theft in this case (Provide police report #)

14) Once you have a detective and a NEW POLICE REPORT # in the delivery jurisdiction (may take days) get him all the info and ask if he can collect the item. Explain how this harmed you company, they may need to get the jurisdiction attorneys involved as payroll has to be allocated.

15) Give the delivery jurisdiction Detective this link https://pages.ebay.com/securitycenter/law_enforcement.html this will allow ebay and law enforcement to w work together.

16) If the Detective doesn't want to or cannot assist you with a pick up then its time to get your attorney involved. Depending on your jurisdiction you may have a 3X civil theft case.

If the name on the account is not a real name or a real business then you really have no more you can do you are simply out and should speak to your business insurance.

Guest checkout is a big part of this problem.

This is going to take a while, but it is worth while. Please let us know how it turns out.

Wait, why did eBay restrict your account? Have you had additional problems? In this case because eBay had to step in to refund, they gave you a defect on your account. Since that was grossly unfair, I would ask them to remove that defect. Obviously you didn't refund because he didn't send you back your item. Defects downgrade a seller's status on eBay, can cause you to pay higher final value fees, and sometimes eventual suspension. How many defects do you have?

Just checked your listings and see 715 of them. Usually when a seller is restricted, eBay will remove the listings. So just to clarify, what kind of restriction did you receive? Or are you talking about seller limits, which can prevent more listings from being added, but is not a punishment for violating policy the way a restriction can be. Most sellers operate under selling limits of some kind. There are dollar amount limits, category limits, and number of items allowed to be listed. If that is the case, each month you can ask eBay to raise your limits. Here is a link with more information:
