Does not pay to be nice

I had a buyer return late a new item they had used 2 1/2 months without filing a claim. I explained that I was on vacation and could not open my mail at the moment but would do so when I returned. That was not good enough for her. She opened up a claim 2 days ago so I sent her a reminder about being on vacation.  Because it is Christmas time I decided to be nice and told her that I would return her money once I checked the item. I returned yesterday and the new cashmere scarf was totally used and had cat hair on it. Well this morning I got a notice from Ebay saying that she had proved her case and I had until today to return the money. Mind you that it has only been 2 days since filing her claim. It does no good to appeal as sellers who do that automatically get defects.

From now on I will never return money for items over 30 days. This buyer obviously knew that Ebay always sides with the buyer.  SAD.

Yep, you should have had the choice to decline the return.

How could she file a claim with eBay if she had it for over 2.5 months?

They can file and the seller can decline the return.

Same as they can file an UID even when tracking clearly shows delivered. Doesn't mean they can win, but they CAN file.

As with most posters something was left out. No they cannot get a refund through Ebay after 2 1/2 months.

They can IF the seller accepts the return.

Paypal gives a longer window for dispute (180 days from payment) but the buyer is required to pay for trackable return shipping.

 

This is often enough to stop a silly NAD claim in its tracks.

I just wanted to say I also live in MD. I too at times feel I get taken advantage of for being nice. I shipped one bracelet instead of the 2 a buyer ordered and immediately sent out a bracelet priority mail and apologized.  The buyer saw this as a chance to get EBay to give them a free bracelet.   eBay sided with me.

Appeal the determination, request that ebay recognize, observe, and act in accord with their own policy!

This case was not filed by the buyer within a timely manner.

Sorry this happened to you. I had something similar happen to me with a pair of pants - buyer wore them around and let her cat roll around on them. They were obviously used and covered in animal hair. eBay sided with the buyer, of course, despite me contacting them directly and telling them the item was clearly used.

Unless the buyer admits to altering the item in some way, eBay will side with them. Literally the only time I was able to with a SNAD case was when the buyer admitted to washing the item. This was documented through messages and I won the case. Next time try asking what was wrong with the purchase and see if you can get them to admit they wore the item or something like that.

My response: NOTHING was left out. I agreed to return her price if the scarf matched the description as I clearly stated due to just my being nice. Ebay can do whatever it wants and the seller cannot stop it. Sure I could have appealed but every time in the past I always got an immediate denial and defect. The buyer can also fie a claim with PayPal for 6 months if they want. I have been selling for 20 years with TRS for 2 Ebay stores. I do think I know what is happening. Ebay has changed to a completely buyer favored company. I do realize it was my mistake to offer a refund it it matched the description. I figured after 23 1/2 months Ebay might consider that.

I was also 'nice' and let a buyer start a return even though it was outside my window and now have that money on hold in PP. Why do I get the feeling I'll be refunding her the original shipping?
