Do I have the right to cancel a BIN order without being subject to negative feedback?

So, I just had a buyer issue, guy was asking for partial refund even before the item was delivered because he felt he "overpaid".  Once he got it, he claimed it wasn't as described so he could get the refund.

 

I was worried of a possible issue with the buyer even before I shipped after I looked through his feedback.

 

Since you can't leave negative feedback for a buyer, there's no way of blocking these possible problem buyers with the bidder/buyer rules.

If I put a clear disclaimer in my descriptions that I reserve the right to cancel an order, would that give me justification in doing this after reviewing a buyer's feedback?


Just wondering if there's any way I can avoid future headaches and lost money like this.

No, you do not have such a right. There's a very short list of reasons for canceling a transaction, and sellers can't add to that or adapt it.

 

Some sellers use the "Best offer" option to pre-screen buyers; they deliberately price high and then state in their listings that offers are welcome.  Then they can legitimately decline an offer and put a member on their blocked-bidder list if their feedback history is scary.

While there is nothing stopping you from doing it, it's not eBay sanctioned.

Also, if you do that you will get an out-of-stock defect which will go against your seller standing.  A few too many and you'll be below standard, received higher selling fees, and face possible permanent suspension.

Isnt asking for something not included in the auction a reason for a legit cancellation?

1. No, you can not just Cancel an order without using one of eBay's pre-approved check box reasons .. one of which is Buyer requested and another is problem with the address.  If you cancel incorrectly you get a strike on your account and enough of those are ... bad ... news

2. Message the Buyer and let them know if they are not happy with the item to process a return request in eBay's Resolution Center.  Get that thing back and out of that Buyer's hands.

3. If Buyer leaves neg FB call eBay and ask them to review the messages and the unethical request for a partial refund before they ever got the item and have them remove the FB.

4. Also, report that Buyer for trying to bully you into a refund.

5. add them to your blocked list

6. DO NOT enter in to ANY conversations with the Buyer about the price of the item, they bought it for the price it was listed and you faithfully shipped it ... just try to look good in eBay's eyes, not that is a guarantee to help but it sure can't hurt.

Sorry that happened to you; definitely not a good buyer there.

 

Unfortunately, that disclosure is unenforceable.  You simply can't reserve that right.  Ebay doesn't like it when sellers cancel sales.  

 

You can and should report that buyer.

The simple answer to your problem-Return the item for a full refund.  That's it.  No return, no money.

I did report the buyer, but I know ebay won't do anything about it. 

 

I don't understand either why it says he has 100% positive feedback when he has tons of negatives (as a seller) but not in the past year (hasn't sold anything lately I believe).

Yeah, I just caved to the partial refund because if he sent it back, I'd be out about the same amount of money after what I paid to ship it and ebay charging me the return label.


Then I also run the risk of it not being returned in the same condition I shipped it and losing even more money.

That's actually the only solution I think.  I've thought about doing it that way.  The only reason I don't is because I don't want to spend the time to review and respond to offers all day.

You have your right to handle the situation as you see fit - in this case tho - I would have done things differently because of the principle of the situation as the buyer is clearly in the wrong and you are letting him get away with it and he'll move on to the next buyer and do the same thing without any consequences if they cave too.

 

The reason people sell here is to make money - but you have to have situations like this included in your business plan because they will happen and the site then becomes a haven for those that do this to sellers with no repercussions. Don't get me wrong - I've given partials if I've misidentified or not noticed a problem and the seller still wants to keep the item but I've also lost a few $$ in situations like this so that I can get the buyer on Ebay's radar. They do keep track of these types of situations and a buyers returns when they falsely claim SNAD and a seller notifies them of it.

That is why the ploy of the partial refund scammer works.  They know this, too.  eBay assists in the shakedown of the seller.  Feedback doesn't count for anything anymore so basically that "threat" is off the table.  It all boils down to MONEY. 

 

You have to do what is right for you, but just pointing out why the scam is successful.  

 

I have found that simply sticking to the "return for refund" mantra anyway most of the time results in them NOT returning anything at all. You already got the service metric ding for the not as described claim anyway.  You are also correct that you will be refunding no matter what is in the parcel that the buyer sends back. 

 

So sorry you were faced with this dilemma.  It is not a plesant activity.

Always return for refund, never cave in to partials, this is exactly what he set out to do, done it before and he most certainly will do it again, i'd rather lose a few $ than let them get away with it, this place is now rife with this because some sellers shake in their boots as soon as Negative is mentioned, as another poster pointed out he already moved you one step closer to the additional 4% fees by opening a Snad which is a lot worse than a Negative,and you reward him with your money, you could have replied to the Negative along the lines " No refunds given until the item is returned " you could also have a chance of feedback removal because he was already asking for money even before delivery, the reply tells other wannabee scammers you are not giving in to partials also.
