Determining Price Gouging

Who is determining what amount an item is selling for is price gouging? And who determines the products that are essential? I've just had kids multi vitamins listings, elderberry, and vitamin C listings taken down due to a price gouging policy? I've sold many and have all positive feedbacks from buyers.  Besides competitors and random users using the price gouging report option, who sits determining what is too much to sell an item for? Sellers are selling the same items for double the amount.. I just dont agree with this. I sell on Ebay to try and make extra money. I dont sell on ebay to lose m ok ney or break even..

For one thing there is no federal law on price gouging, the Feds leave it up to each state to have a law, some states have it some don't. Ebay itself has the right to set their own rules.

Thank you.  We see a lot of messages here from sellers who are indignant that they can't list this or that item on eBay.  As you mention, it's eBay's site, so it's eBay's rules.  If eBay wants to ban the listing of little red wagons or green T-shirts, they are perfectly within their rights to do so.

Wow. I wish I were in that group. If I live to be 200 with the health of a 20 year old, I would never complete my "to-do" list as it now stands, even if I were to never leave my home.  I cannot imagine having nothing to do. Things I might postpone doing because it's not the most pleasant, but it not needing to get done? These bored folks can come clean out closets and cupboards, organize file cabinets, wax the floor, water the plants, hand write some cards/letters, back up the computers, paint the living room wall, design and create the holiday wreath, cook foods to go into the freezer, vacuum the car, sew on missing buttons, dust the ceiling fans before it gets warm enough to use them, change the heater filter, scan the family photos into digital folders, (among other things) ... I can find something for them to do.  Wow.

I just saw a can of Lysol Disinfectant Spray listed for $75.00. EBAY item number:
153908970657, Seller rockangelmarla. If that isn't price gouging, what is?
I plan on reporting the seller to the federal government.

@tracerpup, it looks like that can of Lysol already sold as it's on their "Sold items" list. Someone bought it for $60, so it probably was a Make Offer listing.  I hope whoever bought it isn't going to ingest it.  I'm glad you're going to report it to an authority other than eBay, because when it comes to price gouging, it seems to me that eBay has done very little to prevent price gouging no matter how many times such listings are reported. Someone on a different thread once left a link to the Attorney General's office in CA for reporting such matters since that is where eBay is located.

Yes when the defense production act is invoked the Feds can get involved with price gouging but the defense production act has only been used very rarely and only covers things that are designated. You first get a warning and you do not lower prices you get charged. This is the only time the federal government gets involved. Once the act is removed there are no federal laws to stop price gouging it is left up to the states. Ebay of course can set it own rules at anytime for anything it wants.

The point is you previously said there are no federal laws.  Clearly there are which is all anyone has really said on this thread.  No one went into details of the does and don'ts.  So that was my only point for providing you with the link to the story.  Just to correct that there are federal as well as state laws that protect consumers against price gougers when we are in a declared state of emergency.

It seems as though ebay has found a way to take advantage of sellers again and make a profit off it.  I used ebay’s suggested price and listed the item lower, and a couple days later got another email from them stating that they have decided the price was considered gouging, so they will end it and keep listing fee $$.  They have also welcomed and now supporting scammer buyers that are using “report price gouging” as means to retaliate for not getting refund because they have buyer’s remorse or Claiming item damage w/ no pics to try to get item fir free or because disgruntled seller  is selling same item and makes report so lower price item is ended by ebay and their higher priced item remains and sells.  win win for them

and Ebay.  So, ebay allows the item to be listed, suggests a listing price, then claims at any given time (I got email 5 days after item already sold stating it was being removed and they’re keeping fees).  There is nothing essential about ocean water hand soap.  However, isn’t clothing essential in our country due to laws?  How come I can sell a $20 shirt for $75?  Why do I pay Target $2.00 for an item they paid .20 cent for?  Because we live in The United States and have the right and privilege to buy what we want with our money.  However, it seems others think that someone who has access to shopping and a credit card isn’t capable of determining what they want or should spend $$ on or thinks ok to

intervene and tell them they are paying too much.  The government is attempting this too as we’ve all seen right now. How free are we?  Where is our bill of rights?  The lack of respect for what people went through to fight for us to have the privileges and rights we have and individuals that think they know better is trifling.  Believe me, I wish it didn’t cost $8.00 to send a bar of soap from the east cost to the west using the federal service that will take 10 to get there unless I pay $15 and it will take 5...if it makes it at all.  at that point, I’m paying ebay and shipper and packing material and time. And then have the buyer complain because they were never looking to “buy” anything, they were looking for way to get what they want for free...so now, Ebay forces me to give them $$ or takes it, and still keeps their fees, so how much $$ am I in at that point??  Seriously??  Who is price gouging who?? Where is that advertised?  It’s not, because no one would sign up for that.   There are also buyers that think ebay is “freebay”.  So, unless you give them items for free and pay to ship it to them for free,  they are taking up eBay’s offer to report items, which Ebay is  encouraging because they get guaranteed $$ from ending and keeping any associated fees and also getting the fees from the “reporters” that sell the item for 3x’s more than the one they reported and Ebay.  Why else would Ebay suggest a price, allow the listing and then claim the listing against policy.  They provided the means and information to list and price it.  I believe this could lead to class action.  I’ve asked for item price list in writing.  But, yet to receive.  Same with request for process of verifying prices and criteria...crickets.  I have my own worries and problems.  Definitely do not have time to cruise Ebay looking for items to report or look at items not in my budget.  I’ve been asked by multiple buyers for more of the product I was selling.  I had to explain that mother Ebay says they can’t have it or they will allow it to be sold, and then penalize.  It’s a hard time enough time for everyone in our country for many Of the same and different reasons..at the same time.  Sellers rely on the income from selling to support their household and families.  Buyers have the right to buy or browse and basically do whatever they want...sellers are at risk and forced to pay ebay and buyers if use site and until other sites are at capacity to take over the monopoly that ebay has going on at the moment and put them out of business by providing a true professional and ethical business model, or seller’s quit using.. it’s definitely become a seller’s risk to use the site.  It’s very unfortunate that  Ebay and the bad apple buyers and disgruntled people have used it as way to make money, get free items  and block people from getting items they want/need who prefer to buy online.  There is nothing truly essential that is sold on Ebay or anywhere else for that matter. Did our forefathers need name brand toilet paper and white tea linen foaming antibacterial soap to survive?  Yes, Ebay and proclaimed volunteer “price reporters” claims that those items are essential and listing them violated “policy”.  That’s what we’re working with here folks, so proceed with caution unless you want to give Ebay and scammers your $$.

I bought my work shoes for $100. They were essential if I wanted the job. A different retailer had them for sale at $49. But, they don’t do good business or have any customer service. Since my shoes were essential, should I sign myself up to call the government to make a report of price gouging? Maybe I should sue my employer for making me buy the shoes. Maybe I’ll get somebody arrested!!! Or, maybe I’ll use that time to show gratitude to have a place to buy what I need. Maybe, I’ll use the time that I was looking to cause drama and spread negativity to pick up groceries for my 80 year old neighbor. Maybe I’ll take the time that I was going to judge people and tell
them how much they should spend for items they want and have the means to purchase while trying to block them from doing so and At same time block and cut off means for people selling items that haven’t received their government assistance check and have 3 children and disabled family member in the household to support and offering to sell items as way to do so. I bet there is a neighbor you could lend a hand to, or maybe a nice card you could send to someone having hard time right now, definitely a food pantry that could use your help. You won’t ever know the difference you could male in someone’s day if you’re sitting around looking for ways to cause trouble. Just some alternatives to possibly consider instead

Yes to this. I was too going off of "suggested prices" that eBay conveniently didn't make any attempt to correct that part. So I really want to know what eBays profits were for those 6 weeks, just to see if it made a significant increase in revenue. People are so up in arms with seller's using EBAYS GUIDELINES but not at all concerned with EBAY MAKING MILLIONS OF OFF SIGNIFICANTLY PRICE GOUGED ITEMS!!

Leave the stuff on the store shelves, so people that need it can buy it and stop trying to make a huge profit.

You are assuming a lot.  Ebay cancelled many of those transactions.  But I'm interested in seeing where you are getting your numbers from.  Please provide more information.
