How can a seller that receives one negative everyday 365 days a year remain on eBay? That's some serious defect rate!:

Negative feedback doesn't count as a defect.

That is no defect rate at all. Sellers get defect points for problems such canceling transactions, or not responding to a buyer's claims of items not received or not as described.
A seller with a high number of transactions could get 365 negatives but still have a customer satisfaction rating of 99%; it's all about the arithmetic.

A seller with a lot of negative feedback dodged a bullet. If those unhappy customers had instead filed a Dispute, they would have received a refund and the seller might actually have been given a Defect, if he had to be forced to refund. (A voluntary refund or other amicable settlement does not trigger a Defect.)
The number of negative feedbacks is less important than the number of positive feedbacks.
The number of negative feedbacks is less important that what those FB say. Watch for a pattern of complaints about loss in mail, slow shipping, poor quality goods or unpleasant communication.
Even more important is the FB left for others. Sellers use this to spot difficult to please customers and block them.

I would ask if it's a big seller, but the low feedback percentage tells me it's likely not. For the big sellers, eBay likes to scrub the negatives from their feedback.

Defects are only for items you find on your Seller Dashboard in the section called Your Seller Level. The areas on this screen are the only stats you can get an actual defect on.

Have you noticed most of the Chinese sellers, they get hundreds of neg's a month, but they get enough positive to keep the percentage up.

Why? For years sellers had to deal with that and finally Ebay came to their senses on this matter. FB left by the buyer or the seller is a personal opinion. Sometimes it is based in fact and sometimes it isn't.
Ebay has developed what they feel are better ways to eval a seller and it can be harsh. So if the seller is behaving on transactions, it is going to show up and the appropriate actions will get taken. It is no walk in the park selling on this site.

And some buyers no matter what you do can not be satisfied. That doesn't mean the seller did anything wrong, it simply means the buyer wasn't happy. The two are not necessarily the same thing.
You seem to want to see this in black and white. It just isn't that. Your own FB shows that.

But that doesn't mean that the seller did anything wrong. I had a customer at my B&M job today who wanted to return an item that was very clearly labeled on the order form and shipping label as being an online-only item that could not be returned to a store. She left unhappy when I told her that she couldn't return that here because our system quite literally cannot process online-only items (they aren't in our system at all). Was it our fault? Nope, it was hers for not reading the great big "THIS IS AN ONLINE-ONLY ITEM THAT CANNOT BE RETURNED IN STORES" that was right there on the order form that she tried to hand to me for the return.
