I recently purchased some Giveaway PROMO bags from a seller on Ebay to resell. I was flagged that the items were counterfeit. I argueed the case and my item was reinstated. Only to be flagged again...however the entire time the person that sold me the bags was still selling. How is it ok for me to purchase the bags however I can't sell them...makes no sense and what I'm told by Ebay makes to sense either.

It could be your not paying your extortion money to Ebay, or at least to the right thief.

Do you buy and sell on the same account? Maybe the seller you purchased from is reporting you because they don't want the competition.

What kind of bags? Like tote bags? Are they branded? or just some generic type of bag? Could it have been a VERO takedown if they were branded?
Sorry, really no clue, just throwing stuff out here...

And this is what I mean when an item is removed, no matter what CS tells you do not relist this item again. The next take down could be fatal.

Because China does not have the same trademark violation standards that we have in this country, and Ebay knows that and protects them.

Counterfeits are not ok anywhere. Problem is in accurately identifying them, and in disciplining the people who sell them. We have no idea how many sellers are taken down from China or anywhere else.........justifiably or in error........

From what Ive read about China's trademark infringement laws, the American mgfr must hire attorneys in China to represent them in court. And if the stats are true that there are thirty million sellers on Ebay, I would bet half of those sellers are Chinese scammers. So you are talking about mgfr's in this country paying millions of dollars in legal fees in China..probably not worth it to them.

Even if they have no IP rights being "violated" in China, they SHOULD be forced to follow US rules when listing on a US site.
"It's ok in China" is a pretty lame excuse for a venue to allow counterfeits to be listed by offshore sellers.

Agreed..but Ebay will never do that,with their huge Chinese revenue..they continue to shield and protect them.Meg Ryan was the one who shoved the Chinese market onto Ebay,knowing it would generate millions in sales.
