I have seen over a dozen books of these Superman 30th Anniversary GOLD CGC 9.8 books up for "PRE SALE". I have never done a pre sale of any kind before. I looked up the terms and it states that a presale MUST be shipped within 30 days of purchase. This book was released on a website to buy on the 2nd. It WILL not ship until "SOMETIME in january 2023". My question is this. There have been 7 sold it looks like 1 on bid and another 8 or so up to buy. Can these be sold legally through eBay? If not what repercussions will these sellers face? will see if eBay takes them down at 750 to 1k each. .hmmm. There are already 13 sold and 5 listed now. Gonna be interesting to watch. According to policy shown in the link of which the fellow poster provided; answer seems pretty clear what should be done including the issues sold.

Yes, to be shipped within 30 days of the sale. ebay has been, let us say, rather lax when it comes to enforcement of these rules. You can find a number of very informative blog posts about this subject at:

Can these be sold legally through eBay?
There is no law prohibiting it, so it is not illegal to do. But there is an eBay policy prohibiting it, so it violates eBay policy.
what repercussions will these sellers face?
Anything from nothing to permanent suspension. The penalty for a policy violation is entirely at eBay's discretion.

So this is more of a moral GREY area that never gets addressed. Because some of the sellers I have seen selling this book have been on here for a VERY long time. So im guessing as long as it's completely clear in the auction or BIN between buyer and seller then it will slip through the cracks.

Again, I suggest the blog posts I mentioned. I believe the 30 day requirement is NOT just ebay policy, I believe it is a Federal regulation. I don't have time to check into that, but it's all there....

I don't see any gray about it per policy. I do see gray about it as to the clear evidence. The question will be why one person would have their item pulled and one wouldn't. Cannot really use the absurd speeding analogy (cannot catch them all) some folks use, there is only 300 of them LOL!!!

There is zero assurance that will be the case. In the past even eBay has sponsored "events" so to speak for presales of this nature, with the release dates months in the future of the listings. When called out on the conflict with the actual eBay policy, the 'advertised events' were cancelled. However, some of the same listings were allowed to continue, and others were removed.
Nobody knows how "special" you have to be to get a pass, and not get into trouble with policy violations.
