Hi all,
I sold a $250 garment on 12/15 and it was delivered on the 21th.
The buyer opened a return request yesterday 01/14 for "doesn't fit".
On the return detail page Ebay states that I am not obligated to accept the return.
I do see an option to decline the request.
My question is that if I decline her return will she have a chance to appeal this case to ebay?
Also can she open a case with paypal for item not as described?
This is a clear case of buyer's remorse.
I do have her message for proof in which she says the garment is beautiful but it just doesn't fit.
Please advise. Thank you for answering!

You are okay in this case you can deny the return since she cited the problem as being fit. She can open a case with PayPal for not being as described which will be a lie, they will be able to read the message thread and see the case was closed. In other words, in this case PayPal will not overstep eBay and they will close the case as well in your favor. As for feedback, I’m not sure if you’ll be protected from negatives or not but I have a suspicion that in these cases eBay blocks the buyers ability to leave negatives. I could be wrong on that part however.

PayPal can and will overstep ebay

If you accept the return, the buyer will have to pay return shipping (unless you offer free returns). If they don't have it in the mail within five days, on day six you can close the return.
If you decline the return, the buyer can go to Paypal and file a return, where they will be required to pay return shipping.

So is it typical for paypal to approve buyer's SNAD return request even if the seller can provide the proof showing the buyer simply feel remorse?
I have both ebay return request and buyer's message saying the reason to return is "doesn't fit".
The garment itself is fine.
Who will paypal side with?
Thank you!

OP - not sure who Paypal will side with. I use to think working with the CS at Paypal was easier than working with the CS at Ebay but since Ebay and Paypal have split - things have changed. Paypal can not view any messages on Ebay between you and the buyer. You can upload those messages - but we can't say how they will decide.
Even if they side with you - a buyer can then go to their credit card company and do a chargeback. I won my case on Ebay in which a buyer claimed SNAD and it wasn't. The buyer then did a chargeback claiming SNAD and not only did Paypal have to refund the money but the items were never returned to me and I got hit with a $20 fee from Paypal.
If a customer wants to return - they'll find a way - right or wrong.

With the exception of two cases where buyers shipped the items back to me after eBay closed the return I have never lost a case (I didn’t lose those two either just I refunded since I technically hald the merchandise back) where a buyer opened a not as described case with PayPal. They always close the case in my favor while I’m on the phone with them. They are privy to all the info available to the case. Chargebacks are very difficult to win when you’re in the wrong. I hope this helps, I don’t want you to be scared by some of the comments. Personally I think
you will be okay.

Maybe she funded that way, maybe she didn't. Maybe she files, maybe she doesn't.
I'd say it was worth the effort to deny the return.

Even if the op accepts and it closes in five days because the buyer doesn't return it the buyer can go to PayPal

Yeah I don't run my eBay on fear of what could happen. I've denied many returns none of them filed PayPal. Yes if could happen but if it does it does I'm not off any worse with them filing then if I accepted the return anyhow. So might as well deny and if the file it doesn't make a different that I didn't accept the return is all.

This past April a buyer opened a return request for "doesn't fit." I accepted the return and sent the buyer a refund. The buyer then opened a case for "not as described" and was refunded the cost of shipping both ways. EBay had taken that money from my PayPal account. I called eBay about it and they refunded me the shipping charges.
In this case, the buyer was able to open a "not as described" case after returning an item and receiving a refund for "doesn't fit."

You most certainly can deny the return request since they chose Fit as their reason for the return. However, the buyer can then still leave you negative feedback, especially if their feedback comments are vague and it will stand.
Also, they can file with Paypal and change their original reason for wanting to return the item to one that would have been acceptable to ebay (like SNAD), and if they send the item back and provide that tracking info to Paypal then Paypal WILL refund them money. Just had one of these last month. Brand new item, buyer returned used after l denied the return request from ebay for Fit and they opened a claim with PP for a completely different reason and were able to provide return tracking info. I provided Paypal copies of the original ebay Return Request showing they had originally stated their reason for requesting a return was due to a Fit issue.
But, since they did return the item, albeit, not in its original condition, they were refunded their purchase out of my PP account and I no longer have an item I can re-sell as NWT.
I did at least file a report on the buyer via the ebay system so hopefully if this is something they do on a regular basis they may eventually get called out on it.
