Buyer left negative feedback and the only thing that was left was
””Seller is a Scam Artist, do not buy from these clowns””””
and then he sent me a message saying after I approved the return several hours later:
“act like a scammer and a clown and get called one. Your even worse than a human, but I figured eBay wouldn’t allow me to call you what you really are. A fraudster.
good job being a jerk “
I contacted eBay and they gave him a strike. I asked eBay to read through the messages I sent to him and the messages he sent to me. EBay said I did nothing wrong.
but eBay won’t remove the feedback until this buyer returns the item purchased. The buyer didn’t read the description of the listing. I’m very thorough in my listings. I explained everything and take several close up detailed pictures.
I’ve already authorized a return. He bought an auction for a cordless vacuum. He had been using the vacuum. The battery stopped holding a charge and he flipped out. In the listing we state the battery, brush roller and filters are used. The battery may not hold a full charge. You are buying a used battery and filter.
we actually disassemble the vacuums and clean them thoroughly to give an experience of a new vacuum cleaner. They are cleaned. We never replace the batteries or filters. We state that in the description.
I believe that I have a very strong case for defamation. And since he left the feedback our sales have completely stopped. We usually sell at least 7-10 vacuums a day. Now basically zero!
the feed back he left doesn’t even mention the item purchased. His feedback is 100% defamation: libel, my business has declined and sales have stopped!
what do you think about this situation?

I think that if the buyer returns and you refund the buyer, eBay will remove the feedback.
Note that the disclaimer "Restocking fee may apply..." in your listings won't fly. Restocking fees haven't been allowed on eBay for some time. You'll need to issue a full refund. Good luck.

Yes I authorized a return. As soon as I get his return I will take 10 pictures of the item and send those into eBay for an investigation on the item being returned. Once we decide on the condition of the item returned. We can either offer a full refund or a partial refund. We sent a clean vacuum. If he sends back a dirty vacuum and we swap out the battery and it works fine. We can issue a partial refund. He’s had the vacuum for almost a month and has been using it. It’s not something that he just received and it had a bad battery. Thank you for the reply

Well, no.
Sigh.
They return.
You refund.
Then and only then do you appeal.
If you don't refund, you still lose the Claim.
eBay will refund the buyer and take their money from your bank account.
The feedback will stay.
You will get a Defect for not cooperating.
Defects can mean higher fees, restrictions on the number and value of future listings, or even a closed selling account.
You have not removed the emotion from your situation yet.

i was actually contacted yesterday by a civil litigation attorney that stated defamation: Libel, only needs to be proven as being malicious with reckless disregard for the truth. I’m supposed to call him back Wednesday
He said the court is looking for false statements published, the statements were made to a 3rd party knowing that they were false. with any damage to reputation. Since there is a grading system on eBay that publicly displays the percentage of a sellers reputation. It does show damages made by the defendants.

Make no mistake, any attorney entertaining making a case out of feedback left on eBay will be taking your money and that is all that will happen.

The buyer left feedback that displayed the buyer's overall feeling about the transaction.
Proving it to be "false" would seem to be difficult.
It is the buyer's opinion.

Drop the whole defamation of character thing out of your mind you're grasping at straws with that one. No one is going to sue someone for a review on Google like you suggest. If anyone has ever successfully sued someone for a feedback that was left on eBay we would have heard about it. It's just not something that's done.
If they opened a return than you can get the feedback removed. Either they return it and then you fully refund them (you can't take out a restocking fee like someone else told you), or they fail to return it and the case closes. As long as the case is opened and you handle everything right on your end, then you have feedback production. I have heard people on this board saying it has to actually be returned and refunded to get the feedback removed. However American eBay reps have told me as long as the return case is opened it will be removed even if they don't return the item (you just can't remove the feedback until after the case is closed).
Somebody once left me a negative feedback and opened a return, but then after I talked to them and showed them proof of authenticity of where I purchased the item from they edited their feedback to positive. They ended up not shipping the item back. When the case closed the positive feedback that they had edited automatically deleted. I think it deleted because it was originally negative before they edited it. Anyway that's my long winded way of saying don't stress too much when this case ends you can get the feedback deleted.

Slow down. You offer Free Returns, You're covered. All you had to do is tell buyer to ship return. When receive give refund. the buyer is made whole. Any feedback left will be removed by Ebay. Don't jump the gun and reply to feedback like you did. it messes with the process. But, Ebay will remove when you get return and refund. That's the beauty of offering free returns.

welli am going through a similiar situation except buyer filed not as decribed case against me and claimed i sent them a different product of lower quality and not the one shown in listing.they also said this in feedback saying i switched it out for another version and many harsh words and lies in feedback.i made a collage of the pictures he sent to me of what he got in mail..i then got pictures from listings and highlighted all the obvious spots that it was indeed the same product and he knew it was to begin with.the product was a lapidary rock slab.this person has been a nightmare abuse name calling ..CRAZY.his feedback left was very defaming.
so i am filling out Notice of False and Defamatory Content" and send to ebay.
i expect it to be removed.

in my case...proving his false statements in a public forum such as ebay feedback will be easy because of pictures proving he is lieing
