What happens when an item is "sold" but the buyer has not paid and does not communicate? It has been weeks. Why does ebay get paid when the item hasn't really sold?

Nothing happens if you don't file the unpaid item case. It is a time sensitive thing to do, and I believe the process changed the first of this month but you would be under the old process. Ebay doesn't know you weren't paid unless you let them know by filing the proper case. Whether or not ebay charges the fees as soon as the item sells varies depending on which payment processer you are using--managed payments or paypal.

You need to file an Unpaid Item case within 32 days of the listing ending to get your fees back. If it has been longer than that then you are out of luck.

if its for the clock you should just file an unpaid item.if the buyer wanted to cancel they could have let you know.
its important to follow thru with non payers and dont forget to go back in 4 days and close it out

To further elaborate, in addition to getting your fees back, the buyer will also receive a 'strike' on their account for doing this and it will make it harder for them to do in the future. All sellers should make a habit of using this process so that they can all help each other cut down on these instances in the future.

It would be nice if eBay waited for the remittance, but they don’t. When a buyer fails to pay, you open an Unpaid Item Dispute. Below is the link to the Help page with all pertinent info.

If it has really been weeks you may want to consider setting your profile to automatically open an unpaid item case xx days after the item closed. I have mine set for 2 days. The other way to avoid the problem is to use buy it now fixed price and check the box that requires immediate payment.

This will seem harsh, but, honestly, if you don't know what to do if/when a buyer doesn't pay, you shouldn't be selling here.
Per eBay rules, if a buyer has not paid within 48 hours of the end of a listing/auction, the seller has 32 days to open an unpaid item case.
After he opens the case, he can return to that case 96 hours later and ask eBay to step in so he can get his FVF refunded. This is the ONLY way that this can happen, so it's very important that a seller knows what to do and does it within the time limit.
