I listed a mint USED Canon camera, detailed that the camera was gently used. Pictures and all the unit was perfect condition but was sold as USED. She bought the camera on December 7th and the filed a return on January 7th. Claiming that the camera was "damaged" but her reason for return is actually that the camera was USED. I told her to reread the listing as she purchased a USED camera. It was a Canon 90d and I sent the SD card with it for FREE to be nice but did not format the card, which I totally forgot to do. But there like 100 or so photos on the card. But this does not mean the camera is broken!
To boot eBay gives me 2 choices to solve the problem either a refund or partial refund. Which is ridiculous, because the listing states that the camera was gently used. The thing was practically new. I'm so frustrated with this situation. And now I have no clue what to do. Anyone know how I can let ebay know this is a false claim or return. Any help would be greatly appreciated.

You also have one other option. Approve the Return and get your camera back before refunding in full. (I tend to find that if an item sells once, it will again.) Get your camera back to relist for the right buyer. Good luck.

You really have only one choice. Accept the return and refund once you get it back in the same condition you sent it. eBay doesn't care if it is a "false claim or return", they will require you to accept it. It stinks I know but that's how it goes on eBay. If this was a claim (which I assume it is because of your no return policy) you have to answer the claim. If you don't, eBay will close it out, refund the buyer from your funds and not require the buyer to return the item. To add insult to injury, you will also get a defect on your account. You really don't want to ignore it. Accept the return in the claim and refund once you get it back.
No returns does not mean no refunds. It just means you force the buyer to go the MBG claim route to get a return done which is never good for the seller.

The "complaint" came in 31 days and 14 hours after the purchase. She claimed she never opened it for the 30 days prior because it was a Kings Day gift. And was mad that it was used.

Technically the 30 day period starts on the date of delivery, not the date of order.

And what if the camera is not in the same condition upon return or the accessoriesare missing? How long do they have to return it to me?

did ebay send you a notice that you have 4 days to resolve the issue before they step in.... I'm not an expert in this areas but if you're past 30 days you're free from ebay forcing the refund as far as I know... but with he price of the item you need to make sure because if they do the refund they will let the buyer keep the camera. Hopefully someone comes in here that knows more about this.

Its 30 days from last estimated delivery date to open a case so if they purchased the 7th it probably took 3-5 days to be delivered is my guess....so they are within 30 day guarantee

That makes sense for sure, so it would be 25 days from when she received it. What happens if I intiate a return and purchase a label and they don't ship it back? Will they still receive a refund and I'm out a camera anyway?

No, if you supply a label and they don't return within the time limit the case will close

It says I have till the 14th to resolve the issue. I guess I have no choice but to take it back.

Do you know if the refund is due when I purchase the label? Or upon receipt of the camera? Sorry I'm just totally new to this and didn't expect it, especially for such a stupid reason. I do appreciate all of the help.
