Wish me luck. If you have read any of my past messages, I was forced to issue a refund because of the USPS covid 19 delay. The package was delivered to the buyer shortly after the refund. Buyer now has package and refund (not fair right?) Buyer said he would pay me back but has yet to do so after a reminder email every 2-3 days.
I called ebay CS this morning and she said I will hear back within 24-48 hours on the appeal. It should be an obviously clear cut case, but like many have stated, they hardly ever rule in favor of the seller. We'll see how this goes. Fingers crossed. Thanks everyone for all your suggestions.

And just an FYI, I called Paypal before calling Ebay and explained what happened but the CS rep told me there was nothing they could do to reverse the refund charge.

Good luck with that. We are having that issue with international shipments. ebay has been made aware of the shipping delays and yet does NOTHING to give the packages more time to arrive. Once USPS stopped most packages from using air and moved them to sea transportation to Europe eBay should have changed the delivery time. But they expect packages to be delivered in the same amount of time. Now the INR filings are taking off and eBay is STEALING the money for the sellers not giving time for the packages to arrive. Their failure to adjust to the changing world will lead to a LARGE case action suit, as it is already in the works.

Isn't it ironic how they can jump on Black Americana in moments and cancel listings but can't seem to fathom delays in shipping because of few international flights - and give sellers no room for delivery. You have to wonder who they think pay their bills.

It seems our Buyers can take months to return an item, but we are expected to refund immediately, hmmmmm

While this practice is beyond painful for sellers (i have two delayed overseas packages right now), to say eBay is stealing is not accurate.
Since we all agreed to grant eBay the right to conduct such matters at their discretion, we are each responsible for our decision to list on eBay despite that risk.
In addition, a class action suit is not likely to go anywhere, as we sellers also agreed to binding arbitration in lieu of court for legal disputes with eBay, with very few exceptions.
Below is the link to the eBay User Agreement where these matters are spelled out. I’m not necessarily saying i agree with eBay’s business conduct. But i’m here because, knowing upfront the terms i must operate within, the financial benefits still outweigh the risks.

I can go ahead and tell you that I was contacted by a third party due to eBay billing policies and they are collecting information about INR during this time. The legal standing that eBay uses does not hold up when they do not adjust their practices to the world around us. The fact that eBay has NOT changed delivery time to locations that the delivery method has been changed is their first issue. ebay has NOT been honest in dealing with the buyers or sellers in this matter. Holding sellers to a standard that at this time not attainable due to changes in available delivery services is unethical at best.

Well, the good news is that the buyer paid me back for the transaction (finally five days after package was delivered). And I got a message from Ebay that I would have lost the case because I voluntarily refunded the buyer. So it was that catch 22 everyone was talking about. Anyway, sometimes it does work out and everyone is happy (he even left me positive feedback).

This issue with overseas shipping has been going on for months now. You all know about it but you continue to sell to buyers who are in places where delivery will be very slow. I don't understand why sellers, as owners of their own eBay businesses, don't make an executive decision to protect their own accounts by stopping selling to these parts of the world.

We pulled our international listings at the end of April once we found out the changes. Yet eBay has not altered their expectations of shipping time nor have they allowed a grace period for those shipments. As you say, it has been going on for months and eBay hasn't addressed it. And as sellers we are NOT allowed to give an estimated time of arrival, it is eBay. The same company that will list your items on the global shipment program or internationally without the seller's consent. The only true way to protect your account on eBay is not to list on the site.

It doesn't matter if it is voluntary on the refund. If you don't, eBay will. Luckily for you, you had an honest buyer. Unfortunately for sellers, eBay is dishonest on managing expectations at this time of delayed deliveries.
