Hello. A little over a year ago I had a co worker sell a
ciuole items for me on eBay. He had an account and had readily sold many items. After he had sold the two items for me, which I had told him I’d pay him a commission for doing so , he was fired from our place if employment. He told me he would get me the money, but he needed to use some of the money until he found a new job. Since that day he has not responded to any texts or emails or phone calls. I know I was naive in thinking that he would pay me back, to the time of over 800 dollars, but is there anything I can mark on his account on eBay? I have his real name but not his eBay name. If I’m just screwed then say so. I’ve pretty much lost faith in the fact he might contact me. Thanks for the long read.

Really nothing can be done through here
Maybe you could file in small claims court and try to recoup some of the money but it costs to do that also

Not a chance anything eBay would do anything for you. They won't give you any of his information, or even confirm he sells on eBay, and they definitely would not act on his account without a court order.
If you do consignments, which I have, you have to get everything, and I mean everything, in writing. They have to see the listing end and what it goes for, have a a receipt for both of you that you both sign when goods change hands, and when another receipt for both of you, both signed, when the money consignment changes hands. You could sue him in small claims if you had the paperwork.

You can write it off your taxes as a theft loss. Document it well though.
You might pay an attorney a little bit to write a threatening letter. However, in some States a verbal/oral agreement carries little weight vs a written one.
Sorry this is your reality. Sounds as though his firing just illuminated for you who he really was.

Since this was a private agreement between you and another member ... filing in small claims court is your only recourse. eBay wasn't involved at all. Good luck!

You might also, if you have the information, drop by his house (or his new job) and have a polite chat about the situation.
I'm serious about the "polite", he may be unsure how to pay you back.
And next time, get it in writing.

No. There is not a thing eBay can do for you or about him. You made a deal between the two of you, and eBay was in no way involved in that deal.
You are just screwed, unless you want to pursue this in small claims court -- and after a year, and with nothing in writing, even there you will have a poor chance of success.

Did you have a written contract with the co-worker spelling out the precise terms of your employment of him as your agent? I'm afraid that without something in writing you may have a hard time proving your case in any type of litigation. Of course, there is really nothing for eBay to get involved in since your agreement appears to be with this individual.
I'm not sure what his being terminated from place of employment has to do with anything. It doesn't appear that your mutual employer had anything to do with your arrangement with him. Did it?

It would be required to use his legal name in litigation rather than his eBay user name. Of course, in the absence of written documentation it would be merely a case of the OP's word against his.
