To my fellow ebayers, My account was recently suspended (one month) for listing a flare gun. I certainly understand that rules are rules and we have to follow them, but here's the thing. The reason I messed up and listed this item is that I found it for sale on ebay and then found a completed listing to copy. I never guessed that a flare gun would be classifed as a weapon although I now see the logic to some degree.
I think ebay could help sellers by improving the software to stop these listings before they become active.
It was a harsh lesson for my company in the forth quarter of the year. Our company is 100% feedback and a top rated seller. We need to ban together and stop unfair treatment of sellers.

Before you list, you need to look at ebay's list of prohibited items.

I know where you are coming from. I listed a copy of Mien Kampf and it was pulled one months after is sold. I also used a completed listing to make the listing. Sorry this happened to you but there is probably nothing that can be done but wait it out and step carefully.
I would stay clear of any gun parts, or related items.

No, I think you missed the point.
You want eBay to do more to prevent you from breaking the rules. Perhaps you should protect yourself by learning the rules, rather than expect someone else to protect you.
If you get stopped for speeding do you complain about all the other drivers speeding too, then complain that the cops didn't do enough to prevent you from speeding?
In either case it is your responsibility to know the rules. Or accept the consequences for making guesses.

A flare gun is not a weapon. It is an essential safety tool for boaters and others who may get into remote areas like skiers and hikers. Some small private aircraft carry them also.

While I agree with you 100%, I think the point is that it could potentially be used as a weapon and that it could cause serious bodily injury if used improperly.
It's silly, but I guess I can kind of understand the logic. I think this is an unfortunate situation.

Ebay specifically states that flare guns are not allowed.

The accidents that can occur from using a flare gun are far more serious and significant from those with a bat, hammer or screwdriver.

This is exactly what I said to all who would listen when I got a Vero for using the term: Veil Crow (sp), in a listing, who knew this was a violation,........(oh eBay did) and as I listed this item it too went active and stayed active for weeks...... then boom a Vero strike.
I, 100% agree with what you are saying, there should have been some pro-active programming that prevented these prohibited items and names from becoming activated listings.

Your point is valid BUT there are thousands of other items sold here everyday that could potentially be used as a weapon. It is NOT a weapon and is in fact a safety related item. Many of eBay's rules are contrary to common sense and that is precisely how sellers like the OP get tripped up by them.
