Abusive feedback?

Is this considered abusive feedback?

 

Seller listed items as Very Good and stated CD's were checked and in perfect condition. I received 2 cd's that were VERY BAD. Many bad scratches and unplayable. Sent message but Seller sent back lying excuses. This Seller is DISHONEST AND DECEITFUL. Shouldn't be allowed to sell on Ebay. Gives Ebay a bad reputation as having a low life scrum bag selling. Seller is a LIAR and CHEATER of buyers. Buyers watch out for this TERRIBLE one.

Calling someone any kind of bag is probably inappropriate language.

I would definitely push eBay on this one.  Yes, eBay tends to keep feedback that "represents the buyer's experience of the transaction", but what about the seller's "experience"?  What if every eBay member were free to post feedback about the entire eBay management staff, from shift supervisors all the way up to the C-suites.  I wonder if they'd consider the "experience" of both parties as equally important then.

 

Specifically, this is a very disruptive buyer.  Have you checked the feedback they have left for others?  It's an option on their feedback page, or at least it was last time I checked.  It can point out members who have a problem integrating into respectful human society and really don't need to be spreading their particular brand of "experience" on the site.

 

The comments left are very egregious in my opinion and are definitely defaming and likely slandering the seller.  There is absolutely no reason for any member to leave such actively malicious feedback.

 

The good side of this is that very few people actually read feedback.  Even a semi-active seller can generally 'bury' the abuse within a few weeks of receiving their normal, positive feedback.  Oddly, and I haven't really taken the time to track this, but it seems like we (at work) receive more positive feedback after getting one of these gutter-crawler diatribes.

 

I'd report it thru the normal channels, and then also thru eBay's Customer Service Chat.  The report thru normal channels goes into a network of black holes, any one of which can draw it down past the event horizon, never to be seen again.  The Chat, on the other hand, creates a permanent record of the conversation.  It's a bit tedious at times - they limit the text you can submit per comment, but you can post as many of those comments as needed to get your point across.  Just remember that the Rep you are talking too is, in many ways, your equal.  They experience our trauma with each call, and are just about as helpless to actually enact change to correct it.  They are not the problem - your buyer was, eBay's brain trust is, and the Internet is even partly responsible (imagine an internet where each person connecting had to provide undeniable confirmation of who they are, and that information is tagged onto everything they do one the 'net -- every email, every page opened, every comment posted.  An internet with consequences).

Especially a 'scrum bag'.

 

I've seen worse and doubt eBay will remove it but it's always worth trying.  They may remove the whole thing or just the diatribe and leave the red donut.

Open  a Not As Described dispute, make him pay to have his CDs returned, then pay to refund you in full.

Nothing hurts more than a wounded wallet.

You are covered by eBay's Money Back Guarantee and also by Paypal's Buyer Protection policy and by the chargeback provisions of the credit card you paid with. (Pick one- and eBay is the fastest )

If he does not cooperate, eBay will refund you and go after him for their money.

They may also raise his fees, restrict the number and value of his listings, and, if he has a track record, may even shut him down entirely.

If an automated feedback removal request was denied you can try contacting a real person.

I would send a private message to the 'ebay for business' page on Facebook. They are usually pretty helpful.

That is a great attitude to have. No sense in allowing a troubled soul to have space in your head. 

Below is the link to Feedback Misuse policy. Sadly, even though it is infuriating to have one’s integrity besmirched, the comment left by your buyer does not violate feedback rules. It doesn't seem right for eBay to allow such name-calling to stand, but they do.

Sometimes in the heat of the moment, a seller will respond to an unfair negative feedback by devolving into name-calling, or defensiveness, or anger. We have all seen ill-advised follow-up comments where the greater damage  done was not from the negative itself, but from the seller’s response to it.

 

Thankfully, your obvious maturity informs your actions. Your response on your other neg was well done. You matter-of-factly dealt with the buyer who was obviously a “problem child”. 

After looking over your listings, i had one suggestion. In the future, if feasible,  you might consider also including photos of the CDs/DVDs themselves in your listings, clearly showing their condition, just to add another level of credibility.

I don't see it as ironic at all -- buyers shopping for high-end name-brand purses on eBay are not likely to be the "typical" buyer for these purses.  My daughter was never so pleased as when she received one of these status purses as a birthday gift (not from me, from her now-ex-husband).  She hadn't quite reached the place she wanted to be in her career, but she was already out-earning her father and advancing rapidly on her mother.  She never ever ever shops on eBay, for anything.  Period.  End of Discussion.  But she's always shops Amazon -- multiple times a month.

 

My daughter is now a 'typical' buyer for these purses.  And she would never be so gauche as to use language as seen in that feedback.  The buyer posting that feedback wanted, and quite likely received, a very status purse for a very bargain price (relatively speaking).  They then screamed and hollered their way thru a return of their previous status purse (same brand, model, color) and basically showed the world why they are not a 'typical' status purse owner.

 

I do see the irony... I just don't feel it's that ironic.  Someone willing to buy-and-swap is very likely someone who regularly uses that kind of language and behavior to get what they want.  The true irony is that eBay sees these folks as "basically good" and continues to allow them to abuse the sellers who supply the inventory that allows eBay to exist.

And that Feedback came from a Christian.

 

I'm sorry, but I can't seem to get past the hypocrisy of that feedback they left against a listing with a title yours had of "WOW Hits Christian Music CD's 2001 2002 2005 2011 And Christmas".  

 

Clearly the buyer has their own issues!!

Its not possible to show every flaw when it comes to optical media like CD's, DVD's, games, etc. The reflection of light will often cancel out scratches entirely, making a carved up disk look like its brand new.

 

This is why I only include an image of the underside of the disk when its super clean to begin with.

 

This is also why sellers need to be honest about the products they sell. I've always refrained from selling disks that have anything more than very light/minor scratches. You don't want to sell someone a disk and not have it work.
