30 day return policy

Hi,

 

I have a question about the return policy. 

 

I sold a set of golf clubs (brand new, direct from manufacturer), in February. They were exactly as described but on day 31 since the actual delivery, the buyer decided to claim he wanted a return because they weren't as described.

 

The buyer received the package (confirmed by tracking on Feb. 25th. (Days 25,26,27,28,29)

The buyer opened a return request on March 26. Days (1-26)

For a total of 31 days.

 

Opened up a dispute with ebay and of course they sided with the buyer. Obviously i have an issue with the fact a buyer can return something that diminishes in value as soon as it is sold (Car, golf clubs, etc.) But I have accepted this issue because ebay has found loopholes to agree with a buyer, such as claiming the item is not as described. It is a shame that they don't help protect sellers at all, which will not be conducive to long term development of the company. It is a very short term outlook which will catch up with them by losing peoples trust. That aspect is starting to compound because I was briefly aware of issues before I decided to do business on ebay.

 

My main question and topic of discussion is how do I go about appealing a decision of a return when it clearly is outside of the 30 day return time-frame (Buyer opened a return on the 31st day)? ebay has admitted to Days Feb. 25th-March 26th and then back tracked to saying it arrived on Feb. 26. Although I have the tracking and delivery confirmations. 

 

I have asked a friend (lawyer) what he thinks and he said it is clearly a breach of contract cause of action. I am only looking for ebay to rectify the mistake on their end and rescind the charge to me. I know they do not want to go through the hassle so they have stopped replying to me. 

 

Any suggestions would be greatly appreciated.

1)  Shipped directly from the manufacturer ?? I am guessing you are an authorized dealer then since I thought Ebay doesn't allow dropshipping unless you are ?

2)  There is verbiage in in the Ebay User Agreement that you allow them to make final decisions.

3)  If Ebay didn't allow the return due to 31 days they could have filed thru Paypal or filed a credit card chargeback?

4)  If you lawyer friend is so knowledgeable about this, let him handle it ?

5)  Appeal? Ebay indicates no proof of what was sent out.  

 

No I stopped selling around 2006, not that I was a big seller anyway, when I realized at that time things were going way downhill for sellers, but I have read this stuff (above) on here for years.

I see you are a brand new sellers?

 

Would really help you to study these forums for awhile before continuing to sell and read the user agreement.  Selling Ebay is NOT as easy as Ebay leads you to believe with sell item, get paid !

4. I want to fix it asap before I stress anymore. ( just got furloughed at work because of virus)

5. Yes, appeal the return because it is not within the 30 day period

 

I totally understand, I will be doing the same thing here if it doesn't work out for me.

I have sold on ebay here and there for over 10 years. High price items that generates ebay pretty solid fees. I have had an issue with them before, but nothing where it was going to cost me this much money.
I will have to read through the user agreement more thoroughly for other companies, but probably not again for ebay.

Could be that day 1 is Feb 26 not Feb 25.

Let me give you some seasoned advice that I have given others in your situation. Start smaller. WAY smaller. As a new seller, don't be drop shipping items. I don't know ebay rules on that nor do I care because I have no personal interest in doing drop shipping. Whatever I sell, I want in my hands to see exactly what I am selling before it gets to my buyer's hands. You see the drawback of what you are doing now, don't you? You have no way of verifying if those clubs were damaged, if the buyer just didn't get around to opening the package until the last day or maybe the buyer is truly ripping you off. You are selling some fairly expensive stuff as a newbie seller. Like I said. Start smaller. I'd seriously start with golf balls , tees, and other low dollar equipment if you want to sell golf related equipment and start building some feedback and a customer base then work your way up.

I don't mean to be rude but you are seriously going about this the wrong way....

 

But maybe you own an actual business and want to branch out into ebay. Good luck there. You are giving ebay a lot of control that you may have at your business. You are now at the mercy of ebay and PayPal.

I have sold a decent amount of clubs over the past 10 years years through ebay. Never had an issue. I wouldn't consider my self a veteran or a first timer.

 

The main thing I wanted to dispute is ebay granting a refund/return after their 30 day time-frame. I understand the buyer wanted return, but per ebays guidelines for returns, it is outside of the time frame.

Interesting.

Why do you have a (4) feedback rating? It appears you are a brand new users.

I understand your frustration with the return policy. Ebay became very pro-buyer if you've been gone awhile.

Their return policy states: 

 

A buyer must request a return and select the replacement or exchange option no later than 30 days after the actual (or latest estimated) delivery date, or, if the seller's return window is longer, within the return window.

 

I believe this means the day it was delivered as day 1.

720 hrs in 30 days and this is happened after 720 hrs from when it was delivered.

No worries. I have been very on and off over the years. My first account was with my college email and then i didnt use ebay for a few years and lost access to that email address. 

So I had to start a new account.
