i sold something and on day 36 they wanted to return it for not having correct description. it was correct. would i still be obligated to refund them . why would ebay even attempt to have me refund them after so much time has gone by?

eBay will allow buyers to open returns after the 30 days from delivery date.
The return should allow the seller to decline the return if it is past 30 days from the delivery date.
Be aware that the buyer can also file a credit card chargeback and eBay does not have any say in the outcome, especially if the case is a Item Not As Described case. If they used PayPal, they can file through them as well.

they went straight to a payment dispute with there bank. so that means im pretty much screwed on excepting the return

That is a horse of a different color, for sure.
You can hope that the banking institution will require return of the product though that is not always the case.

You will end up refunding, don't fight it or eBay will steal $20 from you on top of it.
The buyer is smart, knows eBay will give them a hard time and went strait to the bank.
Can you blame the buyer for doing this if they get free product when they do? I don't. I consider eBay like opening a store in a busy mall with for free signs everywhere.
There is no seller protection anymore and there can't be. eBay and banks screwed it up with chargebacks.
